Speciālās izmeklēšanas eksperiments kā izmeklēšanas darbība

Abstract

Bakalaura darba ‘’Speciālais izmeklēšanas eksperiments kā izmeklēšanas darbība’’ mērķis ir izpētīt kā speciālā izmeklēšanas darbība, un tieši – speciālais izmeklēšanas eksperiments, tiek piemērots praksē un kādi ir tā īstenošanas nosacījumi un ar to saistītā problemātika Latvijas Republikas tiesību normās, proti, Latvijas Republikas likumos un normatīvajos aktos, vai šis tiesību institūts ir nepieciešams, pēc kā autore izdarīs secinājumus un izstrādās priekšlikumus tiesību normu aktu pilnveidei, radot labvēlīgus priekšnoteikumus pareizai tiesību normu piemērošanai un nodrošināšanai krimināltiesisko attiecību taisnīgu noregulējumā, lai novērstu prettiesisku un nepamatotu iejaukšanos speciālo izmeklēšanas eksperimentu iesaistīto personu dzīvē, kā arī iztulkot tās tiesību normas, kas tieši attiecas uz pētāmo jautājumu un veikt tiesu prakses pētīšanu. Bakalaura darba pamatā ir izmantotas vairākas pētījuma metodes, tādas kā: pētnieciskās metodes – analītiskā metode, salīdzinošā metode un vēsturiskā metode, un tiesību normu interpretācijas metodes – vēsturiskā metode, sistemātiskā metode, gramatisko metode un teleoloģiskā metode. Bakalaura darbs sastāv no trim daļām un septiņām apakšnodaļām. Darba apjoms ir uz 72 lapām un tajā ir 50 izmantotie literatūras un darba avoti. Bakalaura darba ievadā tiek pamatota izvēlētas tēmas aktualitāte, formulēts pētījuma mērķis, pētījuma jautājumi un noteikti galvenie pētījuma uzdevumi. Bakalaura darbā tiek sniegts speciālā izmeklēšanas eksperimenta jēdziens un tā būtība, kā arī tiek analizēts tiesiskais regulējums un vēsture; pētīts kādos gadījumos speciālais izmeklēšanas eksperiments tiek veikts, noskaidrots kas ir speciālā izmeklēšanas eksperimenta pirmskontrole un pēckontrole, un kādi procesuālie dokumenti ir nepieciešami speciālā izmeklēšanas eksperimenta veikšanai; izpētīta tiesu prakse, lai noskaidrotu, kāda ir speciālo izmeklēšanas eksperimenta iesaistīto personu procesuālā aizsardzība, noskaidrojot ar speciālo izmeklēšanas eksperimentu saistītu problemātiku un provokācijas esamību attiecībā pret iesaistītajām personām. Darba nobeigumā tiek apkopoti būtiskākie secinājumi un izstrādāti priekšlikumi tiesību normu aktu pilnveidei, radot labvēlīgus priekšnoteikumus speciālā izmeklēšanas eksperimenta pareizai tiesību normu piemērošanai un krimināltiesisko attiecību taisnīgai noregulēšanai, lai novērstu prettiesisku un nepamatotu iejaukšanos personu dzīvē. Darbā tiek izmantoti Latvijas un ārvalstu autoru zinātniskie darbi, Latvijas normatīvie akti, judikatūra un tiesu prakse, interneta avoti.

The purpose of the bachelor`s thesis “Special Investigation Experiment as Investigation Action’’ the aim is to study how a special investigative activity, and exactly - a special investigative experiment, is applied in practice and what are the conditions for its implementation and related problems in the legal norms of the Republic of Latvia - in the laws and regulatory enactments of the Republic of Latvia, whether this institute of law is necessary, after which the author will draw conclusions and develop proposals for improvement of legal norms, creating favourable preconditions for correct application and ensuring fair settlement of criminal investigative experiment in the life of the persons involved, as well as to translate the legal norms that are directly relevant to the researched issue. Several research methods, which have been used as the basis for the bachelor`s thesis – research method – analyzing method, comparative method, historical method and methods of interpretation - historical method, systematic method, grammatical method and teleological method. The bachelor`s thesis consists of 3 chapters and 7 sub-chapters. Thesis consists on 72 pages and 50 of used literature sources. The introduction of the bachelor's thesis justifies the topicality of the selected topic, formulates the aim of the study, the hypothesis of the work and determines the main tasks of the research. The bachelor's thesis provides the concept and essence of a special investigative experiment, as well as analyzes the legal framework and history; researched in which cases the special investigation experiment is performed, and clarified what is the pre-control and post-control of the special investigation experiment, and what procedural documents are necessary for the performance of the special investigation experiment; in the bachelor’s thesis the case law has been studied in order to find out what is the procedural protection of the persons involved in the special investigation experiment, ascertaining the problems related to the special investigation experiment and the existence of provocation in relation to the persons involved. Conclusions are summarized and proposals for the improvement of legal norms are developed, creating favorable preconditions for the correct application of legal norms and fair settlement of criminal relations in order to prevent unlawful and unjustified interference in persons' lives. In the bachelor's thesis is used scientific works of Latvian and foreign authors, Latvian normative acts, case law and internet sources.
