Maģistra darbā veikts pētījums par valsts kompensācijas cietušajiem tiesiskā regulējuma teorētiskajiem un praktiskajiem problēmjautājumiem. Spēkā esošās likuma normas nenodrošina vienlīdzīgu attieksmi pret visiem cietušajiem vienādos un salīdzināmos apstākļos. Likuma “Par valsts kompensāciju cietušajiem” 7.1 panta ceturtā daļa noteic valsts kompensācijas maksimālā apmēra proporcionālu sadalījumu atkarībā no cietušo skaita, kas var novest pie vienam cietušajam izmaksājamās kompensācijas apmēra nesamērīga samazinājuma. Secināts, ka valsts kompensācijas tiesiskais regulējums nenodrošina taisnīgu un samērīgu kompensāciju. Konstatēti vairāki problēmjautājumi likuma “Par valsts kompensāciju cietušajiem" normu praktiskajā piemērošanā.
Par pētnieciskā darba mērķi izvirzīta valsts kompensācijas cietušajiem tiesiskā regulējama teorētisko un praktisko aspektu analīze, lai izstrādātu priekšlikumus tā pilnveidošanai.
Maģistra darba apjoms ir 94 lpp.
A study on theoretical and practical issues of the legal framework for State compensation of victims has been carried out in the Master research work. The existing provisions of the law do not ensure equal treatment of all victims under the same and comparable conditions. Section 7.1, paragraph four of the Law on State compensation for victims prescribes a proportional distribution of the maximum amount of State compensation depending on the number of victims, which may lead to a disproportionate reduction in the amount of compensation to be paid to one victim. It is concluded that the national compensation legislation does not provide fair and proportionate compensation. Several problematic issues have been identified in the practical application of the provisions of the Law on State compensation for victims. The aim of the research work is to analyse theoretical and practical aspects of the legal regulation of State compensation for victims in order to develop proposals for improvement thereof. The amount of research work is 94 pp.
