Abstract
Maģistra darba tēma ir “Lobisms valsts amatpersonu izvēlē ( Valsts policijas amatpersonu iecelšana)”. Policijas kā valsts vai pašvaldības institūcijas pienākums ir aizsargāt sabiedrības un valsts vitāli svarīgākās intereses no noziedzīgiem nodarījumiem un citiem prettiesiskiem apdraudējumiem. Policijas amatpersonas realizē publisko varu, kas uzliek īpašu atbildību par savas rīcības tiesiskumu sabiedrības priekšā. Ir svarīgi saprast, kādi cilvēki realizē šo varu, kas ir viņu amatā nokļūšanas patiesi mērķi, vai tā ir laba pārvaldība, godīgs, caurspīdīgs demokrātisks process. Vai arī amatā iecelšanas procesā ir saskatāmi lobisma mehānismi to formālajā vai neformālajā izpausmē. Darbā autore ar teorijas un empīriskā pētījuma kvalitatīvo un kvantitatīvo metožu palīdzību veiks izpēti saistībā ar valsts amatpersonu, tai skaitā, Valsts policijas amatpersonu iecelšanas procesa tiesiskumu.
Maģistra darbs sastāv no trīs nodaļām, pirmajās divās tiek aprakstīts teorētiskais koncepts, kas atklāj labas pārvaldības principus, lobisma jēdzienu un birokrātijas izpratni. Trešajā daļā tiek veikta izpēte, akcentējot uzmanību Valsts policijas amatpersonu darbam. Darbā izvirzītais mērķis ir noskaidrot, vai Valsts policijas amatpersonas iecelšana amatā ir lobisms. Mērķa sasniegšanai tiek izvirzīti vairāki uzdevumi. Pirmais no tiem, izpētīt teorētisko konceptu par labas valsts pārvaldības principiem saistībā ar valsts amatpersonu iecelšanu amatā, t.sk. Valsts policijas amatpersonu iecelšanu amatā, otrais, izpētīt teoriju un sabiedriskās diskusijas par lobisma ietekmi un riskiem valsts amatpersonu iecelšanā t.sk. Valsts policijas amatpersonu iecelšanā; trešais, izanalizēt, vai valsts policijas amatpersonu iecelšanā saskatāms lobisms. Kā arī, izteikt secinājumus un sniegt ieteikumus par lobisma ietekmes amatpersonu iecelšanas amatā atklātību atbilstoši labas pārvaldības principiem.
Veicot izpēti, autore izdarīja trīs nozīmīgus secinājumus, kas saistīti ar lobisma regulējuma neesamību un tā nepieciešamību; Saistībā ar gadījuma izpētī: Valsts policijas priekšnieka process neatbilst labas pārvaldības principiem un tajā ir lobisms.
The topic of the Master's thesis is “Lobbying in the selection of state officials (appointment of the State police officials)”. The duty of the police as a state or municipal institution, is to protect the vital interests of the society and the state from criminal offenses and other illegal threats. Police officials perform public authority, which imposes special liability for legality of their actions in front of the public. It is important to understand what persons perform this authority, what are their real purposes for getting the position, is it good governance, an honest, transparent democratic process. Or in the appointment procedure are visible lobbying mechanisms in their formal or informal way. In this thesis the Author with the help of theory and qualitative and quantitative methods of empirical study will perform research on the legality of the process of appointing public officials, including State police officials. The Master's thesis consists of three chapters - in the first two chapters are described the theoretical concept, which reveals the principles of good governance, the definition of lobbying and understanding of bureaucracy. In the third part, research is carried out the peculiarities of the work of state officials and the appointment procedure, emphasizing the work of State police officials. The aim of the thesis is to find out whether there is lobbying in appointing the State police officials. For achieving the aim, several tasks are set out. The first of them, to explore the theoretical concept of the principles of good governance in connection with appointment of state officials, incl. appointment of State police officials, the second, to explore the theory and public discussions on the impact and risks of lobbying in the appointment of state officials, incl. appointment of State police officials; the third is to perform the empirical study. Also to state conclusions and provide recommendations regarding lobbying effect transparency in the appointment of officials in accordance with the principles of good governance. Conducting the research, the Author made three important conclusions, what are related to the absence and necessity of lobbying regulation; In relation to the case study: the Chief of the State police process does not comply with the principles of good governance and involves lobbying.
