Medicīnas māsu profesijas reforma Latvijā: tiesiskie aspekti

Abstract

Māsu profesijas reformas ir iezīmējušas būtisko lomu veselības aprūpē. Šobrīd tiek attīstīts izglītības iespējas, kā arī vajadzīgās zināšanas, lai pilnībā tiktu stiprinātas un izglītotas liels skaits vispārējās aprūpes māsu. Māsu profesijas reformas sniedz redzējumu nākotnē, kas noved pie lielāku prasmju līmeņu attīstības. Bakalaura darba mērķis ir starptautisko, nacionālo un ārvalstu tiesību aktu, Latvijas tiesu prakses, judikatūras, publikāciju, kā arī citi pieejamie juridiskās prakses materiālu analīze, to interpretācija kopsakarībā, lai atklātu māsu profesijas reformu tiesiskā regulējuma īstenošanas problemātiku, analizējot esošās problēmas, un izsakot priekšlikumus tiesiskā regulējuma pilnveidošanai. Bakalaura darbu veido ievads, trīs nodaļas, kas ir sadalītas apakšnodaļās, un nobeigums, kurā ietilpst secinājumi un priekšlikumi, kā arī izmantotās literatūras avotu saraksts. Darba struktūra sastādīt, lai secīgi atklātu māsu profesijas reformas Latvijā: tiesisko aspektu īstenošanas problemātiku. Darba ievadā ir pamatotas pētāmās tēmas aktualitātes gan ar statistikas datiem, gan ar nozīmīgākajiem tiesiskā regulējuma grozījumiem, tiek norādīts pētījuma mērķis, kā arī mērķa sasniegšanai izvirzītie uzdevumi. Norādīti pētījuma priekšmets un objekts, kā arī uzskaitītas un aprakstītas pētījumā izmantotās metodes un tiesību normu interpretācijas (iztulkošanas) metodes. Darba pirmajā nodaļā autore aplūko māsu profesijas vēsturisko attīstību, definē māsas jēdzienu un veidus, kā arī tiek uzskaitīti māsu profesijas veidošanās principi un raksturojums Eiropas valstīs, kas veido māsu profesijas attīstību starptautiskā līmenī. Bakalaura darba otrajā nodaļā autore aplūko māsu profesijas starptautisko tiesisko regulējumu un tā standartus. Tiek aplūkota Apvienoto Nāciju organizācija cilvēktiesību tvērumā, kā ari Eiropas Cilvēktiesību konvencija. Tiek aplūkota veselības aprūpes darbinieku brīva pārvietošanās Eiropas Savienībā. Darba trešajā nodaļā autore izskata nacionālo tiesisko regulējumu, kurš regulē māsu profesijas reformu attīstību un pilnveidi. Tiek pētīts tiesiskais regulējums, kā arī notiekošo reformu pamats un turpmākie reformu plāni. Pamatojoties uz pētījumā iegūtajiem empīriskajiem rezultātiem, kā arī uz zinātnisko avotu teorētisko analīzi, ir izdarīti secinājumi un izteikti priekšlikumi. Bakalaura darbā izmantotās literatūras saraksts sastāv no 54 avotiem latviešu, angļu valodā, oficiālām publikācijām un tiesību aktiem.

Reforms in the nursing profession have highlighted a key role in health care. Educational opportunities are being developed, as well as the knowledge needed to fully strengthen and educate a large number of general care nurses. Reforms in the nursing profession provide a vision for the future that leads to the development of higher skill levels. The aim of the bachelor's thesis is to analyze international, national and foreign law, Latvian court practice, case law, publications, as well as other available legal practice materials, to interpret them in order to reveal the problems of implementing the legal regulation of nursing profession reform, to analyze existing problems and make proposals, and improvement of the legal framework. The bachelor's thesis consists of an introduction, three chapters, which are divided into subsections, and a conclusion, which includes conclusions and suggestions, as well as a list of references. To compile the structure of the work in order to reveal the reforms of the nursing profession in Latvia: the problems of implementation of legal aspects. In the introduction to the work, the topicality of the research topic is substantiated with both statistical data and the most significant amendments to the legal framework, the aim of the research is indicated, as well as the tasks set to achieve the goal. The subject and object of the research are indicated, as well as the methods used in the research and the methods of interpretation (translation) of legal norms are listed and described. In the first chapter, the author examines the historical development of the nursing profession, defines the concept and types of nursing, and lists the principles and characteristics of the formation of the nursing profession in European countries that shape the development of the nursing profession at the international level. In the second chapter of the bachelor's thesis, the author looks at the international legal framework of the nursing profession and its standards. The United Nations in the field of human rights, as well as the European Convention on Human Rights, are considered. The free movement of healthcare workers in the European Union is under consideration. In the third chapter, the author examines the national legal framework that regulates the development and improvement of the nursing profession reforms. The legal framework is being examined, as well as the basis for ongoing reforms and future reform plans.
