Darba koplīgumu nozīme nodarbinātības tiesiskajās attiecībās

Abstract

Darba koplīgums ir viens no nodarbināto tiesiskajiem instrumentiem, kura mērķis regulēt nodarbinātības tiesisko attiecību saturu, it īpaši jautājumos, kuri saistīti ar darba samaksu, darba aizsardzības organizāciju, darba tiesisko attiecību nodibināšanu un izbeigšanu, darbinieku kvalifikācijas paaugstināšanu, kā arī darba kārtības, darbinieku sociālās aizsardzības un citus ar darba tiesiskajām attiecībām saistītus jautājumus, un nosaka savstarpējās tiesības un pienākumus. Darbā analizēts – Darba koplīguma jēdziens un tiesiskais regulējums, Darba koplīguma noslēgšanas īpatnības, darba koplīgumu noslēgšanas problēmas valsts iekšējās drošības iestādēs un valsts pārvaldē. Darba mērķis: izpētot darba koplīgumu jēdzienu, noslēgšanas nosacījumus, izzināt tiesiskā regulējuma problēmas, izstrādāt ieteikumus darba koplīgumiem saistošā tiesiskā regulējuma pilnveidei Darba uzdevumi: 1.Izpētīt darba koplīgumu jēdzienu 2.Analizēt darba koplīgumu noslēgšanas procesu; 3.Analizēt darba koplīgumu noslēgšanas problēmas valsts iekšējās drošības iestādēs. Pētījumā secināts, ka darba koplīgumiem ir svarīga loma darba tiesisko attiecību noregulēšanā, tomēr pašlaik privātā un publiskā sektora darba un dienesta reglamentējošos normatīvos aktos nav sakārtota, ir problēmas noslēgšanas un spēkā stāšanās īpatnībās un ierobežojumi, kuri noteikti atsevišķām valsts amatpersonām. Pētnieciskā darba apjoms – 60 lapas.

A collective agreement is one of the legal instruments of employees, the purpose of which is to determine the content of the employment relationship, in particular the organization of pay and employment protection, the establishment and termination of employment relations, the training of employees, relations and establish reciprocal rights and obligations. Analyzed in thesis - the concept and legal regulation of the collective agreement, the peculiarities of concluding a collective agreement, the problems of concluding collective agreements in the state internal security institutions and public administration. Aim of the work: by studying the concept of collective agreements, the conditions for concluding them, to find out the problems of the legal regulation, to develop recommendations for the improvement of the legal framework binding on collective agreements Tasks: 1. To study the concept of collective agreements. 2. Analyze the process of concluding collective agreements. 3. To analyze the problems of concluding collective agreements in the state internal security institutions. The study concludes that collective agreements play a significant role in the regulation of employment relations, however, at present is not settled enough, there are peculiarities of concluding and entering into force of the problem and restrictions imposed on public officials. The number of pages of research work - 60 pages.
