Viltus ziņu izplatīšanas aizlieguma tiesiskā problemātika

Abstract

Bakalaura darba tēma ir “Kriminālatbildība par nepatiesu ziņu izplatīšanas noteikšanas perspektīvas”. Šobrīd Latvijas Republikas krimināltiesiskajā regulējumā trūkst skaidras tiesību normas, kas noteiktu kriminālatbildību par nepatiesu ziņu izplatīšanu gan ar mērķi traucēt sabiedrisko mieru, gan ar mērķi apdraudēt vai graut valsts demokrātiskās sistēmu un valsts pamatintereses. Bakalaura darba mērķis ir analizēt tiesības uz vārda brīvību un Krimināllikuma 81. un 231. pantu, konstatējot potenciālo problemātiku piemērojot kriminālatbildību par nepatiesu ziņu izplatīšanu kā arī piedāvāt priekšlikumus nepatiesu ziņu izplatīšanas ierobežošanai. Pētījuma ietvarā autore analizēja tiesības uz vārda brīvību vispārējo ietvaru un būtību, kā arī ierobežojošos aspektus ar nolūku identificēt ierobežošanas piemērojamību attiecībā uz nepatiesu ziņu izplatīšanas ierobežošanu un aizliegšanu. Papildus tam, autore uzsvaru darba ietvarā arī lika uz nepieciešamību izprast digitālās tiesības un to izpausmi, pamatojoties, ka digitālajā laikmetā visplašāk nepatiesu ziņu izplatīšanās ir novērojama tiešsaistes vidē. Galvenais akcents pētījumā tika likts uz Krimināllikuma pantu analīzi uzvērtējot pastāvošās nepilnības, kas ir attiecināmas uz nepatiesu ziņu ierobežošanu un šo ziņu būtību. Pētījuma rezultātā secināts, ka šobrīd trūkst aktuālas tiesību uz vārda brīvību interpretācijas sasaistē ar šo tiesību izpausmi un īstenošanu digitālajā vidē. Papildus ir secināts, ka nepastāvot konkrētam tiesiskajam regulējumam, nepatiesu ziņu izplatīšana apdraud ne tikai sabiedrisko kārtību, bet arī Latvijas Republikas neatkarību, suverenitāti, teritoriālo vienotību, valsts varu un valsts iekārtu.

The topic of the bachelor's topic is "Prospects for determining criminal liability for the dissemination of false news". At present, the criminal law regulation of the Republic of Latvia lacks a clear legal norm that would establish criminal liability for the dissemination of false information both with the aim of disturbing public peace and with the aim of endangering or undermining the country's democratic system and state’s core interests. The aim of the bachelor's thesis is to analyse the right to freedom of expression and Articles 81 and 231 of the Criminal law, identifying potential problems in applying criminal liability for the dissemination of false information, as well as to offer proposals for restricting the dissemination of false information. In the framework of the study, the author analysed the general framework and nature of the right to freedom of expression, as well as the restrictive aspects in order to identify the applicability of the restriction in relation to the restriction and prohibition of the dissemination of false information. In addition, the author also emphasized the need to understand digital rights and their expression, based on the fact that in the digital age, the spread of false news is most widespread in the online environment. The main emphasis of the study was on the analysis of the articles of the Criminal Law by assessing the existing shortcomings that are attributable to the restriction of false information and the essence of this information. The study concludes that there is currently a lack of current interpretation of the right to freedom of expression in relation to the expression and exercise of this right in the digital environment. In addition, it has been concluded that in the absence of a specific legal framework, the dissemination of false information threatens not only public order, but also the independence, sovereignty, territorial integrity, state power and state system of the Republic of Latvia.
