Bērnu tiesības aizsardzības likumā noteikto bērnu pamattiesību tiesiskais regulējums, un praktiskās īstenošanas problēmas

Abstract
Bakalaura darbā “Bērnu tiesību aizsardzības likumā noteikto bērnu pamattiesību tiesiskais regulējums un praktiskās īstenošanas problēmas” izpētīta Bērnu tiesību aizsardzības likuma II nodaļa par bērna pamattiesībām no 7. panta līdz 17. pantam. Lai spētu labāk izprast, izpētīt un noskaidrot tiesisko problēmu, likumā atrunātās tiesības tika iedalītas divās grupās – tiesības, kas tiek aizsargātas no vecāku vai aizbildņa puses un tiesības, kuru aizsardzību regulē un nodrošina valsts. Jānorāda, ka šis iedalījums nav strikti noteikts, jo tiesības savā starpā mijiedarbojas.
Tēmas aktualitāti apstiprina statistikas dati, no kā secināms, ka ir sarucis adoptētāju skaits Latvijā, tādēļ tiek ierobežotas bērnu tiesības uz ģimeni. Pedagogu trūkumu dēļ, tiek ierobežotas bērnu tiesības uz izglītību. Kā arī palielinās to vecāku skaits, kuri publicē savu bērnu fotogrāfijas sociālajos tīklos, tādējādi tiek aizskartas bērna tiesības uz privātumu, jo bildes kļūst pieejamas svešiem cilvēkiem, turklāt netiek pienācīgi izvērtēts, kā tās ietekmēs bērna dzīvi viņam pieaugot. Tādēļ, lai sašaurinātu tēmu, darbā tiks pievērsta lielāka uzmanības tieši šīm pamattiesībām, tiesiskās problēmas aktualitātes dēļ.
Bakalaura darba mērķis ir Bērnu tiesību aizsardzības likumā noteikto bērnu pamattiesību analīzes un praktiskās īstenošanas pētījuma rezultātā, identificēt problemātiku un izstrādāt tiesiskā regulējuma grozījumus normatīvajos aktos saistībā ar bērnu tiesību nodrošinājumu uz dzīvību, privātumu, uzaugt ģimenē un citām pamattiesībām.
Rezultātā darba autore izteic secinājumus, izvirza savus ieteikumus saistībā ar Bērnu tiesību aizsardzības likumā atrunātajām bērnu pamattiesībām. Kā galvenos secinājumus autore izvirza tiesībām adoptēt bērnu abām personām, kaut arī nav reģistrējušas savas attiecības, neatrunāt audžuģimenes līgumā laika periodu kurā bērns tajā atradīsies, kā arī ieviest jaunietēm valsts atmaksātas konsultācijas pēc grūtniecības pārtraukšanas.

The author of the Bachelor paper “Legal regulation of the fundamental rights of children and problems of practical implementation specified in the Law on the Protection of the Children's Rights” is being explored Chapter II Fundamental Rights of the Child of the Law on the Protection of the Children's Rights from section 7. to section 17. In order to be able to better understand, investigate and clarify legal problem, the rights enshrined in the law were divided into two groups: rights protected by parents or guardian and rights governed and guaranteed by the state. It should be noted that these groups are not strictly defined, because rights interact with each other. The topicality of the Bachelor paper is confirmed by statistics, it can be concluded, that the number of adopters in Latvia has decreased, therefore the rights of the children to have the family are restricted. Because of the lack of teachers, the rights of the children to education are limited. Because of the increasing number of parents who publish the photos of their children in social networks, the rights of a child to privacy are being infringed, as the pictures become available to strangers, without properly assessment of the how pictures will affect the child's life in the future. That is why in order to narrow down the topic, there will be more focus on these fundamental rights, due to the current legal challenge in the Bachelor paper. The aim of Bachelor’s paper is the result of the study of the legal regulation of the fundamental rights of children and practical implementation specified in the Law on the Protection of the Children's Rights, identify issues and develop legislative amendments to the legislation regarding the provision the children's rights to life, privacy, rights to the family and other fundamental rights. As a result, the author of the paper draws conclusions, puts forward her recommendations regarding the fundamental rights of children, which are enshrined in the Law on the Protection of the Children's Rights. As the main findings, the author puts forward the rights to adopt a child for both persons who are not married to each other, do not specify in the foster family contract the time period the child will be in it and enforce the State ensure consultation for woman after termination of pregnancy.
