Abstract
Maģistra darba temats ir „Tiesības uz maternitātes un vecāku pabalstiem Latvijas Republikā” un mērķis ir izpētot maternitātes un bērnu vecāku pabalstu tiesisko regulējumu un tā sasaisti ar darba tiesībām Baltijas valstīs un identificējot problēmas, izstrādāt ieteikumus Latvijas tiesiskā regulējuma pilnveidei.
Ņemot vērā esošās nepilnības Latvijas Republikas tiesiskajā regulējumā saistībā ar bērnu vecāku pabalstiem un to, ka Latvijas Republikas tiesības aktos vēl nav ieviestas Eiropas Parlamenta un Padomes Direktīvas (ES) 2019/1158 (2019. gada 20. jūnijs) par darba un privātās dzīves līdzsvaru vecākiem un aprūpētājiem un ar ko atceļ Padomes Direktīvu 2010/18/ES prasības, ir nepieciešams aktualizēt esošo tiesisko regulējumu saistībā ar bērnu vecāku pabalstiem. Darbs sastāv no četrām nodaļām un četrām apakšnodaļām, un tā kopējais apjoms ir 90 lapaspuses.
Darba izstrādes gaitā darba autore ir konstatējusi, ka, Latvijas Republikas normatīvajā regulējumā saistībā ar bērnu vecāku pabalstiem ir jāveic vairāki būtiski grozījumi, lai normatīvais regulējums atbilstu Eiropas Savienības prasībām. Tāpat, darba autore ir izpētījusi Lietuvā un Igaunijā piemērojamo normatīvo regulējumu saistībā ar bērnu vecāku pabalstiem, norādot, kādi grozījumi būtu nepieciešami Latvijas Republikas normatīvajā regulējumā, lai veicinātu vienlīdzību starp Baltijas valstīm.
The topic of the master's thesis is "Entitlement to maternity and parental benefits in the Republic of Latvia" and the aim is to study the legal regulation of maternity and parental benefits and its connection with labour law in the Baltic States and identify problems to improve the Latvian legal framework. Taking into account the existing shortcomings in the legal framework of the Republic of Latvia regarding parental benefits and the fact that the requirements of the Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers and repealing Council Directive 2010/18/EU have not yet been implemented in the legislation of the Republic of Latvia, it is necessary to update the existing legal framework for parental benefits. The work consists of four chapters and four subchapters, and its total volume is 90 pages. During the elaboration of the work, the author of the work has established that in the regulatory framework of the Republic of Latvia in connection with parental benefits several significant amendments must be made for the regulatory framework to comply with the requirements of the European Union. The author of the paper has also studied the regulatory framework applicable in Lithuania and Estonia in relation to parental benefits, indicating what amendments would be required to the regulatory framework of the Republic of Latvia in order to promote equality between the Baltic States.
