Patiesā labuma guvēja noskaidrošanas tiesiskie aspekti un problemātika Latvijas finanšu sistēmā

Abstract

Bakalaura darba nosaukums ir “Patiesā labuma guvēja noskaidrošanas tiesiskie aspekti un problemātika Latvijas finanšu sistēmā”. Autors izvēlētās tēmas aktualitāti pamato ar pēdējos gados vairākkārtīgi pilnveidoto un attīstīto Latvijas Republikas normatīvo regulējumu noziedzīgi iegūtu līdzekļu legalizācijas un terorisma un proliferācijas novēršanas jomā. Kā arī ņemot vērā to, ka finanšu sistēmā juridisko personu loma noziedzīgi iegūtu līdzekļu legalizācijā ir ļoti būtiska, to patieso labuma guvēju izpēte un identificēšana ir viens no galvenajiem aspektiem, kas novērš noziedzīgo grupējumu iespējas izmantot juridiskās personas dažādām prettiesiskām darbībām, kas ir saistītas ar ekonomiskajiem noziegumiem finanšu sistēmā. Tādā veidā tiek pasargātas gan valsts sektora, gan visas sabiedrības intereses un tiesības, proti, tiek novērstas nodokļu izkrāpšanas shēmas, korupcijas riski, kā arī publiskie iepirkumi kļūst caurskatāmāki. Bakalaura darba mērķis ir izpētīt pašlaik esošo Latvijas noziedzīgi iegūtu līdzekļu legalizācijas un terorisma un proliferācijas novēršanas jomas tiesisko regulējumu, kā arī tā vēsturisko izveidošanas, kas nosaka patiesā labuma guvēja noskaidrošanas prasības. Izpētīt un apskatīt esošo problemātiku, kas saistīta ar patiesā labuma guvēja noskaidrošanu juridiskām personām un juridiskiem veidojumiem. Bakalaura darba rezultātā autors izvirzīs vairākus izvērstus secinājumus saistībā ar patiesā labuma guvēja jēdzienu un saturisko nozīmi, norādīs uz darba izveides ietvaros konstatētiem pastāvošiem normatīvā regulējuma un praktiskā izpildījuma trūkumiem, kā arī piedāvās risinājumus to novēršanai. Bakalaura darbs sastāv no ievada, trīs nodaļām un nobeiguma. Kopējais darba apjoms sastāv no 63 lapām, neieskaitot titullapu, anotāciju, satura rādītāju un literatūras sarakstu.

The title of the bachelor's thesis is “Legal aspects and problems of determining the true beneficial owner in the Latvian financial system.”. The author justifies the topicality of the chosen subject with several recent changes in the normative regulation of the Republic of Latvia in the field of money laundering and prevention of terrorism and proliferation, which has been repeatedly improved and developed in recent years. As well as the fact that the role of legal persons in money laundering is very important in the financial system, the research and identification of their real beneficiaries is one of the main factors preventing criminal groups from using legal persons for various illegal economic activities. In this way, the interests and rights of the public sector and society are protected, namely the prevention of tax fraud schemes, the risks of corruption and the transparency of public procurement. The aim of the bachelor's thesis is to study the current legal framework in the field of money laundering and prevention of terrorism and proliferation in Latvia, as well as its historical establishment of determination the requirements for identifying the true beneficiary. To study and look at the existing issues related to the identification of the true beneficiary for legal entities. As a result of the bachelor's thesis, the author will draw several detailed conclusions in relation to meaning of the true beneficiary, point out the existing shortcomings of the regulatory framework and practical implementation, as well as offer solutions to eliminate them. The bachelor's thesis consists of an introduction, three chapters and a conclusion. The total volume of the work consists of 63 pages, not including the title page, annotation, table of contents and bibliography.
