Naida noziegumu identifikācija un izmeklēšana

Abstract

Bakalaura darbā “Naida noziegumu identifikācija un izmeklēšana” pētīta Krimināllikuma 78., 149.1 un 150. pantā paredzēto noziedzīgo nodarījumu identifikācija un izmeklēšana. Tēma ir aktuāla, jo naida noziegumu problēmas ir svarīgas gan sabiedrībā, gan krimināltiesībās, kriminālistikā, kriminālprocesa un policijas tiesībās. Lai arī par naida noziegumiem runā daudz, īpaši pēdējos gados, noziegumu identifikācijas un kvalifikācijas aspektā šī tēma ir maz pētīta. Praksē identificēt, kvalificēt un izmeklēt naida noziegumus ir sarežģīti, īpaši sākotnēji. Naida noziegumiem ir dažādas izpausmes formas, sākotnēji ne vienmēr ir zināmi visi apstākļi, informācija var būt nepietiekama. Praksē rodas juridiska rakstura problēmas: vai klaju naidu paudošs, bet īss komentārs, ir kvalificējams kā naida runa; vai šādi komentāri un naida runa var būt netīša; vai pirmstiesas izmeklēšana ir uzsākama tikai tad, ja ir konstatējams konkrēts cietušais vai cietušo grupa? Viena no juridiska rakstura problēmām ir apstāklis, ka krimināltiesību teorijā nav noteikti kritēriji, pēc kuriem naidu varētu norobežot no negatīvas attieksmes izpausmēm. Pētījuma mērķis: izpētīt naida noziegumu identifikāciju un izmeklēšanu, apkopot secinājumus un ieteikt priekšlikumus. Pētījuma galvenie rezultāti liecina, ka naida noziegumu identifikāciju apgrūtina neziņošana un neizpratne par naida noziegumiem, tāpēc būtiska ir prevencijas nozīme. Naida noziegumu izmeklēšanu apgrūtina to institucionālā nošķiršana, jo izmeklēšanu veic dažādas izmeklēšanas iestādes. Objektīvai situācijas izpētei būtu nepieciešami ne tikai tiesu prakses pētījumi, bet arī izmeklēšanas iestādēs pieņemto lēmumu par atteikšanos uzsākt kriminālprocesu pētījumi.

The bachelor's thesis “Identification and Investigation of Hate Crimes” studies the identification and investigation of criminal offenses provided for in Articles 78, 149.1 and 150 of the Criminal Law. The topic is relevant because the problems of hate crime are important both in society and in criminal law, forensics, criminal procedure and police law. Although there is a lot of talk about hate crimes, especially in recent years, little research has been done into the identification and qualification of crimes. In practice, it is difficult to identify, qualify and investigate hate crimes, especially initially. Hate crimes take various forms, initially not all circumstances are known, information may be insufficient. In practice, there are legal problems: is a hateful but brief comment already qualifying as hate speech; whether such comments and hate speech may be unintentional; Is a pre-trial investigation only open if a specific victim or group of victims is identified? One of the problems of a legal nature is the fact that the theory of criminal law does not specify the criteria according to which hatred can be distinguished from the manifestations of negative attitude. The aim of the research: to study the identification and investigation of hate crimes, to summarize conclusions and make proposals. The main results of the study show that the identification of hate crimes is complicated by non-reporting and misunderstanding of hate crimes, therefore the importance of prevention is important. Investigations into hate crimes are hampered by the institutional separation, as they are investigated by different investigative bodies. An objective examination of the situation would require not only studies of case law, but also studies of decisions taken by investigative bodies to refuse to initiate criminal proceedings.
