Abstract: Bakalaura darba nosaukums ir “Maksājumu pakalpojumu sniedzēju loma tiešsaistes finanšu noziegumu novēršanā.” Pieaugot tiešsaistes finanšu noziegumu izplatībai un to radītajam kaitējumam, arvien lielāka uzmanība tiek vērsta uz šo nodarījumu novēršanu īstenojošu pasākumu ieviešanu un pilnveidošanu. Maksājumu pakalpojumu sniedzējiem ir pienākums identificēt tiešsaistes finanšu noziegumu izdarīšanas mēģinājumus un, cik iespējams, tos novērst. Bet pastāvošajā tiesiskajā regulējumā ir trūkumi maksājumu pakalpojumu sniedzēja tiesībās atteikt identificēta krāpnieciska darījuma izpildi, kas apdraud paša maksājumu pakalpojumu lietotāja un sabiedrības kopējās intereses. Bakalaura darba mērķis ir, izpētot tiešsaistes finanšu noziegumu novēršanas pasākumu normatīvo regulējumu maksājumu pakalpojumu jomā, noteikt tā praktiskās piemērošanas problemātiku un piedāvāt pilnveidošanas iespējas. Tiešsaistes finanšu noziegumi ir sociālās inženierijas noziegumi, kas īstenoti psiholoģiski ietekmējot maksājumu pakalpojumu sistēmas lietotāju un izmantojot kibertelpas resursus. Šādi noziegumi kvalificējami un iedalāmi datorkrāpšanā, krāpšanā ar viltu un krāpšanā ļaunprātīgi izmantojot uzticēšanos, kur tiem ir atšķirīgi to īstenošanas scenāriji un novēršanai nepieciešamo darbību apjoms. Maksājumu pakalpojumu sniedzējiem ar tiesību aktiem ir uzlikti pienākumi nodarījumu identificēšanai to pakalpojumu sniegšanas ietvarā. Identificējot iespējamu apdraudējumu ir tiesības bloķēt autorizācijas rīka izmantošanu un atteikt maksājuma rīkojuma izpildi, komunikācijā ar sistēmas lietotāju gūstot apstiprinājumu vai noraidījumu konstatētām aizdomām par krāpšanu. Minētais tiesību apjoms nesniedz iespēju novērst gadījumus, kur noziegums īstenots ļaunprātīgi izmantojot uzticēšanos, jo maksājumu pakalpojumu sistēmas lietotājs bieži nespēj atpazīt krāpšanas pazīmes un uzstāj uz krāpnieciska darījuma īstenošanu. Tāpēc noslēgumā darba autore izsaka priekšlikumu izmaiņu veikšanai Maksājumu pakalpojumu un elektroniskās naudas likuma 91. panta 3. daļā, piešķirot maksājumu pakalpojumu sniedzējam tiesības atteikt autorizēta maksājuma rīkojuma izpildi gadījumos, kad tas konstatē pamatotas aizdomas par krāpšanu. Darbs sastāv no 61 lpp.
The title of the bachelor's thesis is "The role of payment service providers in online financial crime prevention". As the prevalence of online financial crime and the damage it causes increases, more and more attention is paid to the implementation and improvement of measures to prevent these offenses. Payment service providers have a duty to identify attempts to commit online financial crime and to prevent them where possible. However, the existing legal framework has shortcomings in the payment service provider's right to refuse the execution of identified fraudulent transaction, which jeopardizes the common interests of the payment service user and the public. The aim of the bachelor's thesis is by researching the regulatory framework of online financial crime prevention measures in the field of payment services, identify problems of its practical application and offer improvement possibilities. Online financial crime is a social engineering crime committed with a psychological impact on the payment service user and the use of cyberspace. Such crimes can be classified and divided into computer fraud, fraudulent fraud, and abuse of trust, where they have different scenarios and the extent of the action required to prevent them. Payment service providers are required by law to identify offenses in the context of the provision of their services. When identifying a potential threat, payment service providers have the right to block the use of authentication tool and can refuse to execute a payment order. To assess whether identified threat is true or false payment service provider implements communication with customer. This scope of rights does not make it possible to prevent fraud as abuse of trust, as the payment service user is often unable to recognize the signs of fraud and insists on the execution of a fraudulent transaction. Therefore, the author of the paper proposes to make changes to Section 91 (3) of the Payment Services and Electronic Money Law, giving the payment service provider the right to refuse execution of an authorized payment order in cases where it finds reasonable suspicion of fraud. The thesis consists of 61 pages.
