Abstract

Bakalaura darba tēma ir Fiziskās personas saistību dzēšanas procedūras norise. Tēma ir aktuāla, jo maksātnespējas procesu skaits pieaug, ne visi parādnieki procedūras beigās tiek atbrīvoti no atlikušajām saistībām, jo parādnieks nezināja par ierobežojumiem, Maksātnespējas likuma piemērošana nolēmumos ir atšķirīga, balstīta uz judikatūru. Analizējot un izpētot fiziskās personas saistību dzēšanas procedūras norises tiesisko regulējumu, autore ir konstatējusi nepilnības, piemēram, parādnieki procedūras laikā rīkojas negodprātīgi, kreditori par procedūras gaitu iebilst tikai procedūras beigās, tiesās tiek iesniegti nesagatavoti pieteikumi. Bakalaura darba mērķis ir saistību dzēšanas procedūras fiziskās personas maksātnespējas procesā teorētiskās un praktiskās norises analīze, sagatavojot priekšlikumus saistību dzēšanas procedūras tiesiskā regulējuma pilnveidošanai un spēkā esošā regulējuma vienotai piemērošanai. Darba apjoms ir 61 lapas.

The theme of the author’s bachelor's is the course of the natural person's debt settlement procedure. The theme is relevant because the number of insolvency proceedings is increasing, not all debtors are released from the remaining obligations at the end of the procedure, because the debtor was not aware of the restrictions, the application of the Insolvency Law in rulings is different, based on case law. Analyzing and researching the legal regulation of the natural person's debt settlement procedure, the author has identified shortcomings, for example, debtors act dishonestly during the procedure, creditors object to the course of the procedure only at the end of the procedure, unprepared applications are submitted to the courts. The target of the bachelor's thesis is to analyze the theoretical and practical course of the liquidation procedure in the process of insolvency of a natural person, preparing proposals for the improvement of the legal regulation of the liquidation procedure and uniform application of the existing regulation. Volume of the bachelor is 61 pages.
