Abstract

Bakalaura darba tēma ir “Dalītā īpašuma tiesiskais institūts Latvijā”. Dalītais īpašums Latvijā pastāv kopš Latvijas neatkarības atjaunošanas, kas deformē Civillikumā normas, kas nosaka zemes un ēkas vienotības principu. Dalītā īpašuma problēmjautājumi joprojām nav zaudējuši aktualitāti. Lai daļēji izbeigtu dalīto īpašumu, likumdevējs ir ieviesis jaunu tiesības institūtu – apbūves tiesības, tomēr novērota problemātika attiecībā uz apbūves tiesības līguma slēgšanas regulējumu. Darba mērķis ir izpētīt dalītā īpašuma tiesību institūta vēsturisko attīstību Latvijā, izpētīt un analizēt dalītā īpašuma rašanās pamatus, dalītā īpašuma un apbūves tiesības normatīvo aktu regulējumu un praksi Latvijā, sniedzot priekšlikumus problēmjautājumu risināšanai. Darbs sastāv no ievada, trim nodaļām, nobeiguma un izmantoto avotu un bibliogrāfijas saraksta. Kopējais darba apjoms ir 64 lapas.

The topic of the bachelor's thesis is "The legal institute of shared property in Latvia". In Latvia shared property has existed since the restoration of Latvia's independence which distorts the norms of civil law that determines the principle of land and building being unified. Issues of shared ownership are still relevant. In order to partially eliminate the shared property, the legislator has created a new law institute - construction rights, however problems were observed regarding the regulations of the contract of the construction rights. The aim of the thesis is to study the historical development of the shared property rights institute in Latvia, to study and analyze the emergence of shared property, the regulation and practice of shared property rights and building rights in Latvia, proposing answers for solving of the issues. The paper consists of an introduction, three chapters, the conclusion and the list of sources and bibliography. The volume of the thesis is 64 pages.
