Abstract: Bakalaura darbā tiks pētīta apdrošināšanas līgumu tiesiskā problemātika mājokļa apdrošināšanas līgumu kontekstā, proti, problēmas, kas saistās ar apdrošināmās intereses doktrīnu un tiesisko regulējumu, kas nosaka skaidru un saprotamu apdrošināšanas līgumu. Pētnieciskā darba saturs ir aktuāls ne tikai tādēļ, ka Latvijas juridiskajā literatūrā pietrūkst pētījumu apdrošināšanas tiesībās, bet arī tādēļ, ka minētā problemātika skar gan plašu potenciālo apdrošinājuma ņēmēju, gan jau esošās līgumattiecībās esošo personu loku. Pētījuma mērķis ir sniegt ieteikumus, kā pilnveidot apdrošināmās intereses doktrīnas piemērošanu praksē, piedāvājot jaunu tiesību regulējumu, kā arī pārliecināties, vai šobrīd esošais normatīvais regulējums nosaka pamatprincipus saprotamiem apdrošināšanas līgumu noteikumiem. Pētījuma rezultāti norāda uz to, ka esošais apdrošināmās intereses jēdziens nesasniedz tā mērķi – izpratne aprobežojas konstatēšanu, vai apdrošināšanas līgumā norādītā persona tiesīga saņemt apdrošināšanas atlīdzības izmaksu, kā arī nepieciešami būtiski Apdrošināšanas līguma likuma papildinājumi, kas nodrošinātu apdrošinājuma ņēmēju un apdrošināto tiesisko aizsardzību. Pētnieciskā darba kopējais apjoms ir 67.lpp.
The bachelor’s thesis will study the legal problems of insurance contract within context of home insurance contracts, namely, problems related to the doctrine of insurable interest and legal regulation that determines a clear, understandable insurance contract. The contents of this research are relevant not only because of the lack of insurance law research in Latvian legal literature, but also because of the mentioned problems affect wide range of potential policyholders and persons already in contractual relationship with the insurer. The aim of the research is to provide recommendations on how to improve the application of the insurable interest doctrine in practice by suggesting a new legal regulation and to ascertain whether the current legal regulation sets out the basic principles for comprehensible provisions of insurance contracts. The results of the research indicate that the existing definition of insurable interest does not achieve its aim – the understanding of the doctrine is limited to determining whether the person specified in the insurance contract is entitled to receive insurance indemnity, as well that significant amends must be made to Insurance contract law. This total volume of the research consists of 68 pages.
