Policijas darbinieka goda un cieņas tiesiskā aizsardzība

Abstract

Pētījuma darba mērķis ir policijas darbinieka goda un cieņas tiesiskās aizsardzības regulējuma analīze, ar to saistīto problēmu izzināšana un priekšlikumu izteikšana nacionālo tiesību normu pilnveidošanai. Saskaņā ar šobrīd spēkā esošo tiesisko regulējumu, policijas darbiniekam, goda un cieņas aizskāruma gadījumā, pašam kā privātpersonai jānodrošina sava tiesību aizsardzība, ieguldot savus personīgos resursus. Valsts uzliktie pienākumi policijas darbiniekam rada papildus riskus goda un cieņas aizskāruma gūšanai, taču tiesiska aizsardzība pret šādu kaitējumu kopš 2004.gada vairs netiek nodrošināta. Vīrusa SARS-CoV-2 izraisītās infekcijas slimības Covid-19 pandēmijas laiks aktualizēja akūtu nepieciešamību pēc krimināltiesību normu izmaiņām, attiecībā uz policijas darbinieka goda un cieņas tiesisko aizsardzību. Vadoties no pētnieciskajā darbā gūtajām atziņām un secinājumiem, darba autors izsaka priekšlikumu veikt grozījumus Krimināllikumā, papildinot to ar jaunu normu, nosakot atbildību par varas pārstāvja goda un cieņas aizskaršanu. Pētnieciskais darbs izklāstīts uz 51 lappuses.

The goal of the thesis is to analyze police officers legal protection of honor and dignity, the identification of the problems involved and the presentation of proposals to improve national legal regulation. Under the current legal framework a police officer should be protected by himself or herself as a private person by investing his or her personal resources in the event of a breach of honor and dignity. The duties imposed by the State on a police officer pose additional risks to an infringement of honor and dignity, but legal protection against such damage since 2003 has no longer ensured. The time of the infectious disease caused by SARS-CoV-2, the Covid-19 pandemic, highlighted the urgent need for corrections of criminal law relating to the protection of the honor and dignity of a police officer. In the light of the lessons and conclusions of the research work, the author of the work proposes to improve the Criminal Law by supplementing it with a new rule, that defines the responsibility for infringing the honor and dignity of the public official.
