Dzīvesvietas deklarēšanas tiesiskais regulējums un tā piemērošana

Abstract

Darbā “Deklarētās dzīvesvietas tiesiskais regulējums un tā piemērošana”, darba autore Kristīne Kuļikovska pēta dzīvesvietas deklarēšanas tiesisko regulējumu tā piemērošanu un ar to saistītos problēmjautājumus. Darba mērķis: analizējot dzīvesvietas deklarēšanas tiesisko regulējumu konstatēt problemātiku saistībā ar dzīvesvietas deklarēšanas nekorektu interpretāciju, ieteikt veidu kā pilnveidot Dzīvesvietas deklarēšanas likumu. Darba mērķa sasniegšanai tika izvirzīti šādi uzdevumi: 1) Noskaidrot dzīvesvietas jeb domicila jēdzienu un būtību, 2) Izpētīt dzīvesveitas deklarēšanas kā tiesību institūta ģenēzi Latvijas teritorijā, 3) Noskaidrot, dzīvesvietas deklarēšanu un ar to saistīto problemātiku, 4) Noskaidrot, pašvaldības iesaisti dzīvesvietas deklarēšanas problēmjautājumu risināšanā, 5) Izpētīt, citu valstu pieredzi dzīvesvietas deklarēšanā. Darba izstrādes laikā autore secināja, ka Dzīvesvietas deklarēšans likumā tika atklātas problēmas saistībā ar dzīvesvietas, kā termina interpretāciju, novecojušu terminu izmantošanu, deklarēšanu bez tiesiskā pamata, jo likums nenosaka nepieciešamību iesniegt dokumentus, kas apliecina tiesisko pamatu, dzīvesvietas iespējamību deklarēt nekustamajā īpašumā bez faktiskas iespējas tur dzīvot. Līdz ar to ir nepieciešams papildināt Dzīvesvietas deklarēšanas likumu. Darbs ir apkopots 68 (sešdesmit astoņās) lappusēs, saturs 67 (sešdesmit septiņi) izmantotos avotus, kā arī 6 (sešus) pielikumus.

In the work “The legal regulation of the declaration of residence and its application”, the author of the work Kristīne Kuļikovska studies the legal regulation of the declared place of residence, its application and related problems. Aim of the work: by analyzing the legal regulation of declaration of residence, finding the interpretation of problems, incorrect interpretation of declaration of residence, to suggest a way to improve the Law on Declaration of Residence. To achieve the goal of the work, the following tasks were set: 1) To find out the concept and essence of residence or domicile, 2) To study the genesis of life declaration as an institute of law in the territory of Latvia, 3) Find out the declaration of residence and the related problem, 4) To find out the involvement of the local government in solving the problems of declaring the place of residence, 5) To study the experience of other countries in declaring the place of residence. During the development of the work, the author concluded that The Residence Declaration Law only reveals problems related to residence as an interpretation of the term, use of obsolete terms, declaration without a legal basis, because the law does not require the submission of documents confirming the legal basis, declaration of residence in real estate without actual opportunities to live there. Therefore, it is necessary to supplement the Law on Declaration of Residence. The work is summarized in 68 (sixty eight) pages, contains 67 (sixty seven) sources to use, as well as 6 (six) appendices.
