Fizisko personu datu aizsardzības tiesiskais regulējums videonovērošanas jomā

Abstract

Pēdējo gadu laikā, tehnoloģijām attīstoties, kļūstot lētākām un pieejamākām, aizvien lielāku popularitāti gūst videonovērošanas sistēmu uzstādīšana. Latvijā, tāpat kā jebkurā citā Eiropas Savienības dalībvalstī, šī tendence arī ir kļuvusi aktuāla. Viens no pamatiemesliem videonovērošanas sistēmu uzstādīšanai ir vēlme pasargāt savu īpašumu. Tiesiskā regulējuma nepieciešamību nosaka fakts, ka, veicot videonovērošanu, notiek ievērojama iejaukšanās personas privātajā dzīvē. Līdz ar to jau vairākus gadus, gan ES, gan nacionālā līmenī ir izstrādāti nepieciešamie normatīvie akti, kas regulē fizisko personu datu apstrādes procesus. Temats šobrīd ir ļoti aktuāls, jo paralēli attiecīgo normatīvo aktu attīstībai ir novērojams, ka subjekti, kas veic personas datu apstrādi ar videonovērošānas palīdzību, bieži vien nav informēti par tiesisko regulējumu un sekām tā neievērošanas gadījumā. Tāpat ir saskatāmas vairākas problēmas praksē, kuras tiks apskatītas un analizētas šajā darbā. Ņemot vērā iepriekšminēto, autores bakalaura darba mērķis ir izpētīt videonovērošanas vēsturiski attīstījušās tiesiskās un praktiskās problēmas Latvijā un piedāvāt iespējamos risinājumus, kas padarītu samērīgāku datu aizsardzības nepieciešamību ar videonovērošanas rezultātā sasniedzamajiem mērķiem. Darbs sastāv no ievada, 4 (četrām) nodaļām un nobeiguma. Kopējais darba apjoms ir 70 lappuses.

In recent years, with the development of technology, becoming cheaper and more accessible, the installation of video surveillance systems has become increasingly popular. In Latvia, as in any other European Union member state, this trend has also become topical. One of the main reasons for installing video surveillance systems is the desire to protect your property. The need for legal regulation is determined by the fact that video surveillance significantly interferes with a person's private life. Consequently, for several years now, both at the EU and national level, the necessary regulatory enactments have been developed that regulate the personal data processing processes. The topic is very actual at the moment, because in parallel with the development of the relevant regulatory enactments, it is observed that the subjects who process personal data by means of video surveillance are often not informed about the legal framework and consequences in case of non-compliance. There are also several problems in practice, which will be considered and analyzed in this work. Taking into account the above, the aim of the author's bachelor's thesis is to study the historically developed legal and practical problems of video surveillance in Latvia and to offer possible solutions that would make the need for data protection more proportionate to the goals achieved as a result of video surveillance. The work consists of an introduction, 4 (four) chapters and a conclusion. The total volume of the work is 70 pages.
