Piekļuve internetam kā cilvēka pamattiesība pandēmijas ietekmē

Abstract

Bakalaura darbā “Piekļuve internetam kā cilvēka pamattiesība pandēmijas ietekmē” autors pēta jautājumu vai piekļuve internetam būtu atzīstama par cilvēka pamattiesību, kā arī vērtē cilvēktiesību nodrošināšanas interneta telpā teorētiski - praktiskus aspektus un ar to saistītus riskus, tiks piedāvāti tiesiska regulējuma grozījumi un cita rakstura problēmas risinājumi. Darbā tiek noskaidrota cilvēktiesību standartu piemērošana mūsdienu izaicinājumiem, izzināta interneta telpa kā tiesību realizēšanas vieta, izpētītas cilvēktiesības un interneta vide. Darbā rezultātā gūst apstiprinājumu izvirzītā hipotēze, ka piekļuve internetam, īpaši pandēmijas ietekmē, ir saistīta ar cilvēktiesību realizēšanu un daudzu iespēju sniegšanu, tāpēc piekļuve internetam ir atzīstama par vienu no cilvēka pamattiesībām. Darbā tiek izmantoti tādi izziņas avoti kā ārzemju un Latvijas autoru literatūra, plašs internetu avotu skaits, Latvijas un starptautiskais normatīvais regulējums, kā arī tiesu praksē nostiprinātas atziņas. Bakalaura darbs sastāv no 58 lapām.

The author of the bachelor thesis “Internet access as a fundamental human right under the influence of a pandemic” analyses the theoretical-practical aspects of internet access and the provision of human rights in the Internet space and related risks, identifies gaps, offers improvements in the legal framework and other solutions. The application of human right standards to modern challenges is clarified in the work, the internet space as a place for the realization of rights is explored; human rights and the internet environment have been studied. As a result of the work, the hypothesis that the access to the Internet, especially in the context of a pandemic, is linked to the realization of human rights and the provision of many opportunities, and therefore access to the Internet is a fundamental human right. Such sources of reference as the literature of foreign and Latvian authors, a wide number of internet sources, Latvian and international legislation, as well as findings established in court practice were used. Bachelor thesis consists of 58 pages.
