Tiesāšanās izdevumu aktuālā problemātika civilprocesā

Abstract

Pētījumā ir analizēts tiesāšanās izdevumu tiesiskais regulējums Latvijas Republikā un ar to saistītā praktiskās piemērošanas problemātika civilprocesa ietvaros. Kopējais pētījuma apjoms ir 69 lappuses. Pētījuma mērķis ir noteikt problemātiku, kas ir saistīta ar tiesāšanās izdevumu tiesiskā regulējuma piemērošanu tiesu praksē. Pētījuma gaitā ir analizēta nacionālā tiesu prakse, no kuras izriet, ka tiesību piemērotāji neviennozīmīgi interpretē pastāvošo regulējumu, kas saistīts ar tiesāšanās izdevumiem, tādējādi ietekmējot personu pamattiesības uz taisnīgu tiesu. Pētījuma gaitā ir izstrādāti priekšlikumi likumdevējam, izpildvarai un tiesu varai tiesiskā regulējuma pilnveidošanai un vienveidīgas tiesu prakses īstenošanai.

The research analyses the legal framework for costs in the Republic of Latvia and the related problems of practical application in the framework of civil proceedings. The total volume of the research is 69 pages. The aim of the research is to identify problems related to the application of the legal framework for costs in case law. During the research, the national case-law has been analyzed, leading to a non-meaningful interpretation by law enforcement of existing litigation-related legislation, thereby affecting the fundamental rights of individuals to a fair trial. The research has developed proposals for the legislator, executive and judicial authority to improve the legal framework and to implement uniform judicial practice.
