Nepilngadīgā kriminālatbildības īpatnības

Abstract

Darba tēmas problemātika: Šobrīd Latvijas Krimināllikumā ir paredzēti trīs pamatsodu veidi, kas neatbilst juvenālās justīcijas mērķim, savukārt ar 2022. gada 1. janvāri stāsies spēkā Krimināllikuma grozījumi, kuri tika izstrādāti, ievērojot nepilngadīgo tiesiskumu un labākās intereses, taču tik un tā ir novērojamas pretrunas likuma mērķī un pieņemtajās normās. Darba aktualitāte: Autore izvēlējās šo darba tematu, tāpēc ka šobrīd tā ir viena no aktuālākajām tēmām Latvijā, jo esošais nepilngadīgo kriminālatbildības regulējums nav atbilstošs šo personu vecumam, interesēm un vajadzībām, taču nākotnes regulējums (2022.gada 1. janvārī spēkā esošs) ir izveidots, balstoties uz juvenālās justīcijas pamatdomu, lai ievērotu nepilngadīgo individuālās īpašības un vajadzības. Darba mērķis: Analizējot nepilngadīgā kriminālatbildības esošo un nākotnes tiesisko regulējumu, konstatēt problēmjautājumus, izvirzīt priekšlikumus un grozījumus Krimināllikumā, kā arī likumā “Par audzinoša rakstura piespiedu līdzekļu piemērošanu bērniem”. Darba apjoms: 59 lapas, 46 bibliogrāfiskie avoti. Pētījuma rezultāti: Darba autore konstatēja esošā un nākotnes nepilngadīgā kriminālatbildības tiesiskā regulējuma nepilnības un izveidoja priekšlikumus grozīt un papildināt normatīvos aktus.

The problem of the topic of work: The legal framework for juvenile delinquency in Latvia is not consistent with the age, interest and needs of these individuals, but in future regulation (1 January 2022) some types of penalties are at odds with the main aim of criminal penalties. Relevance of the work: The author chose this subject because it is currently one of the most spotlight topics in Latvia, because the existing regulation on juvenile delinquency is not appropriate to the age, interest and needs of these people, but the future regulation (1 January 2022) has been established on the basis of juvenile justice in order to meet the individual characteristics and needs of minors. The aim of the work: Analyzing the current and future legal regulation of juvenile criminal liability, to identify problematic issues and to direct proposals and amendments to the Criminal Law and Law “On Application of Compulsory Measures of a Correctional Nature to Children”. Volume of work: 59 pages, 46 bibliography sources. Results of the study: The author of the work identified the shortcomings of the current and future legal regulation of minors criminal liability and created proposals to amend and supplement the regulatory acts.
