Abstract

Bakalaura darba tēma ir „Administratīvā atbildība pasažieru gaisa pārvadājumos.” Pasažieru gaisa pārvadājumi mūsdienās tiek plaši izmantoti, pieaug to popularitāte un pieejamība. Nodrošinot Šengenas zonas ārējās robežas kontroli, Valsts robežsardze veic personu ieceļošanas, uzturēšanās, ceļošanas tranzītā un izceļošanas nosacījumu pārbaudi. Papildus tam, tiek kontrolēta arī Šengenas zonas iekšējā telpa, veicot imigrācijas kontroli valsts iekšienē. Konstatējot pārkāpumus, pie administratīvās atbildības iespējams saukt gan fizisko, gan juridisko personu, tas ir, gan pasažieri, gan pārvadātāju. Praksē rodas problēmas ar personu saukšanu pie administratīvās atbildības. Bakalaura darba gaitā autors apzinās normatīvā regulējuma nepilnības, kas saistītas ar personu saukšanu pie administratīvās atbildības. Bakalaura darba mērķis ir analizējot administratīvo atbildību nosakošo tiesisko regulējumu pasažieru gaisa pārvadājumu jomā, kā arī tiesu praksi, konstatēt problēmas, piedāvāt risinājumu, izstrādājot priekšlikumus tiesiskā regulējuma uzlabošanai. Mērķa sasniegšanai autora noteiktie uzdevumi ir izpētīt administratīvo atbildību kā juridiskās atbildības veidu, izzināt fiziskas personas administratīvo atbildību pasažieru gaisa pārvadājumu gadījumos, izzināt juridiskas personas administratīvo atbildību pasažieru gaisa pārvadājumu gadījumos, kā arī izpētīt administratīvās atbildības piemērošana pasažieru gaisa pārvadājumos. Lai sasniegtu mērķi, izpildītu uzdevumus un pārbaudītu pētījuma jautājumu, darba autors izmanto tiesību normu interpretācijas metodes un vispārējās zinātniskās pētniecības metodes. Bakalaura darbs sastāv no ievada, četrām nodaļām, secinājumiem un priekšlikumiem kā arī izmantotās literatūras saraksta. Darba pirmajā nodaļā tiks aplūkota administratīvā atbildība kā juridiskās atbildības veids. Otrajā nodaļā tiks pētītas fizisko personu administratīvās atbildības iestāšanās aspekti gaisa pārvadājumu gadījumos. Trešajā nodaļā tiks pētīta juridisko personu administratīvās atbildības iestāšanās aspekti gaisa pārvadājumu gadījumos. Ceturtajā nodaļā tiks analizēta tiesu prakse gadījumos, kad personas tiek sauktas pie administratīvās atbildības par pārkāpumiem imigrācijas jomā. Darba apjoms: 53 lpp., 89 izmantotie avoti.

The subject of the bachelor's work is “Administrative responsibility for passenger air transport.” Passenger air transport is widely used today, its popularity and accessibility are increasing. In ensuring the control of the external border of the Schengen area, the State Border Guard shall perform an inspection of the conditions of entry, residence, travel in transit and exit of persons. In addition, the internal area of the Schengen area is also controlled by means of immigration controls within the country. In the event of irregularities, both the natural and legal person can be brought under administrative responsibility, that is, both the passengers and the carrier. In practice, there are problems with the prosecution of persons under administrative responsibility. In the course of the work of the bachelor, the author wants to identify gaps in the regulatory framework related to the prosecution of persons under administrative responsibility. The aim of the bachelor's work is to analyse the legal framework for passenger air transport, as well as the case law, identify problems, offer a solution by developing proposals to improve the legal framework. For the purpose, the author's tasks are to explore administrative responsibility as a form of legal responsibility, to investigate the administrative responsibility of a natural person in passenger air transport cases, to investigate the administrative responsibility of a legal person in passenger air transport, and to investigate the application of administrative responsibility in passenger air transport. In order to achieve the objective, to fulfil the tasks and to examine the issue of the study, the author of the work shall use methods for the interpretation of legal norms and general scientific research methods. The bachelor's work consists of an introductory, four chapters, conclusions and proposals, and a list of authorities used. The first chapter of the work will address administrative responsibility as a form of legal responsibility. In the second chapter, the administrative responsibility of individuals in the case of air transport will be examined. The third chapter will examine aspects of the accession of the administrative liability of legal persons in the case of air transport. The fourth chapter will analyse the case-law in cases where persons are held under administrative responsibility for immigration offences. Amount of work: 53 pages, 89 sources used.
