Goda un cieņas civiltiesiskā aizsardzība

Abstract

Bakalaura darba tēma ir “Goda un cieņas civiltiesiskā aizsardzība”. Bakalaura darbā ir pētītas aktuālās problēmas un konstatētas nepilnības Latvijas normatīvajos aktos un konstatētas piemērošanas problemātikas goda un cieņas civiltiesiskās aizsardzības lietās. Autore ir salīdzinājusi un izanalizējusi dažādu autoru darbus, izpētījusi nacionālo un starptautisko tiesu praksi, kā arī zinātniskos avotus saistībā ar goda un cieņas civiltiesisko aizsardzību. Bakalaura darbs sastāv no četrām nodaļām. Pirmajā nodaļā “Personas, kas var saņemt goda un cieņas civiltiesisko aizsardzību”, autore noskaidros personas kuras ir tiesīgas saņemt goda un cieņas civiltiesisko aizsardzību, kā arī normatīvos aktus, kas to nosaka un regulē. Analizējot normatīvos aktus, tika noskaidrotas personas, kuras ir tiesīgas saņemt goda un cieņas civiltiesisko aizsardzību. Otrajā nodaļā “Vārda brīvības interpretējums starptautiskajos un nacionālajos tiesību aktos”, autore izpētīs konkurenci starp vārda brīvību un godu un cieņu. Trešajā nodaļā “Civiltiesiskās atbildības pamats goda un cieņas aizskāruma gadījumā”, autore pētīs delikta gadījumus goda un cieņas aizskāruma gadījumos. Ceturtā nodaļā “Aizsardzības līdzekļi goda un cieņas aizskāruma gadījumā”, autore noskaidros kādi aizsardzības līdzekļi ir un var tikt piemēroti goda un cieņas aizskāruma gadījumā. Bakalaura darbs sastāv no 56 lapaspusēm.

The topic of the bachelor theses is “Civil protection of honour and dignity”. The bachelor theses investigate the topical issues and identifies the flaws of the Latvian normative acts, as well as recognizing the problems of civil protection of honour and dignity in case of incident. The author has compared and analyzed the works of multiple authors, researched national and global judicial practices, as well as scientific articles connected with civil protection of honour and dignity. Bachelor theses consist of four chapters. In the first chapter “Individuals, who are eligible for civil protection of honour and dignity” the author determines the normative acts, that regulate and determine individuals, who are eligible for civil protection of honour and dignity, as well as analyzes them. In the second chapter “Freedom of speech interpretation in the global and national legal acts’’ author researches the conflict between Freedom of speech and honour and dignity. In the third chapter “The grounds for civil liability in case of damage to honour and dignity” author researches instances of wrongful acts in cases of damage to honour and dignity. In the fourth chapter “Means of protection in cases of damage to honour and dignity’’ author determines what are the means of protection in cases of damage to honour and dignity. The bachelor thesis consists of 56 pages.
