Abstract

Bakalaura darba tēma ir “Vairāku personu piedalīšanās noziedzīgā nodarījumā”. Bakalaura darba aktualitāti nosaka personas lomas noziedzīgā nodarījumā, kas krimināltiesību vēsturē un attīstībā ir spēlējusi svarīgu lomu, pilnveidojot tiesību normas par līdzdalību vai piesaistību kā atsevišķu tiesību institūtu. Dalības un līdzdalības noziedzīgā nodarījumā jēdzieni, to kopīgās pazīmes un dalības un līdzdalības savstarpējās norobežošanas jautājumi ir aktuāli gan no tiesību normu viedokļa, gan no tiesu prakses. Bakalaura darba mērķis ir izpētīt vairāku personu piedalīšanās noziedzīgā nodarījumā un piesaistību noziedzīgam nodarījumam tiesisko regulējumu, konstatēt praksē sastopamās problēmas un ieteikt normatīvā regulējuma pilnveides risinājumu. Bakalaura darbā autore pēta vairāku personu piedalīšanās noziedzīgā nodarījumā būtību un vispārīgo raksturojumu, personas lomas noziedzīgā nodarījumā un tiesu praksi. Darba autore parāda dalības un līdzdalības kopīgās pazīmes, atšķirības un īpatnības, kā arī atklāj judikatūrā paustās atziņas. Mērķa sasniegšanai, darbā pētīta pastāvošā tiesu prakse, apkopoti dažādu autoru viedokļi, analizēti problemātiskie jautājumi šo jomu piemērošanai praksē. Bakalaura darba struktūru veido ievads, četras nodaļas ar apakšnodaļām, secinājumi un priekšlikumi par aplūkojamo tēmu. Bakalaura darba apjoms ir 60 lapas.

The theme of the bachelor’s paper is „Participation of several persons in a criminal offense”. The concepts of participation or joint participation in a criminal offence, their common features and issues of mutual delimitation of participation and joint participation are relevant both, from the point of view of legal norms and from the case law. The aim of the bachelor’s paper is to study the legal regulation of participation of several persons in a criminal offense, to identify problems most frequently encountered in practice and to come up with suggestions for improvement of regulatory framework. The author of the bachelor’s paper reveals the nature and general characteristics of participation of several persons in a criminal offense, the role of a person in the criminal offense and court practice. The author shows the common features, differences and peculiarities of participation and joint participation, as well as reveals findings expressed in case law. The acquired results give us analysis and understanding of the notion “participation of several persons in a criminal offence”. The structure of the bachelor's paper is made of an introduction, four chapters with sub chapters, conclusions and suggestions on the topic. The paper consists of 60 pages.
