Tiesu varas pamatprincipu īstenošana zemesgrāmatu reformā

Abstract

Bakalaura darba tēma ir “Tiesu varas pamatprincipu īstenošana zemesgrāmatu reformā”. Latvijai kā Eiropas Padomes dalībvalstij ir mērķis veidot tiesisku telpu, kas prasa nemitīgu tiesu sistēmas attīstību un nepārtrauktību tiesu varas pamatprincipu ievērošanā, lai aizsargātu personu tiesības uz taisnīgu tiesu. Darbā analizēta zemesgrāmatu nodaļu reforma, kuras rezultātā zemesgrāmatu tiesneši tika integrēti rajona (pilsētas) tiesu sastāvā ar mērķi veidot tiesisku, efektīvu un sabiedrības vajadzībām atbilstošu tiesu iekārtas darbību, taču aktuāls ir jautājums par zemesgrāmatu tiesnešu kompetenci un gatavību skatīt vispārējās jurisdikcijas lietas. Darba mērķis ir analizējot tiesisko regulējumu un zinātnisko literatūru, identificēt būtiskākās problēmas tiesu varas pamatprincipu īstenošanā zemesgrāmatu reformā un ieteikt risinājumus turpmākajai zemesgrāmatu tiesnešu integrēšanai tiesu sistēmā. Darbs iedalīts trijās nodaļās ar apakšnodaļām: pirmajā nodaļā “Tiesu varas pamatprincipi” analizēti būtiskākie tiesu varas pamatprincipi, otrajā nodaļā “Tiesu sistēmas efektivitāte” analizēta tiesu priekšsēdētāju un tiesnešu loma tiesu varas pamatprincipu nodrošināšanā un īstenošanā, trešajā nodaļā “Zemesgrāmatu tiesnešu integrēšana zemesgrāmatu reformā” analizēti zemesgrāmatu reformas mērķi un pamatotība, kā arī identificētas būtiskākās problēmas reformas īstenošanā saskaņā ar tiesu varas pamatprincipiem. Autore secināja, ka reformas rezultātā tiesu varas pamatprincipi īstenoti daļēji, bet būtisku lomu tiesu reformas īstenošanā ieņem tiesu priekšsēdētāji. Darba kopējais apjoms ir 74 lpp.

The subject of the Bachelor’s Paper is “Implementation of the Basic Principles of Judiciary in the Land Register Reform”. As the member state of the Council of Europe, Latvia aims to create a legal space that requires continuous development of the judicial system and continuity in the observance of the basic principles of judiciary in order to protect the right of individuals to a fair trial. The Paper analyses the reform of the Land Register Departments, as a result of which Land Register Judges were integrated into district (city) courts with the gaol of creating legal and efficient activity that corresponds to the public needs, but the issue of the competence of the Land Registry Judges and their readiness to review cases of general jurisdiction is topical. The goal of the Paper is to analyse the legal framework and scientific literature, to identify the most significant problems in the implementation of the basic principles of judiciary in the Land Register reform and to recommend solutions for further integration of Land Registry Judges into the court system. The Paper has been divided into three chapters with subchapters: the first chapter “Basic Principles of Judiciary” analyses the most important basic principles of judiciary, the second chapter “Efficiency of the Judicial System” analyses the role of Court Presidents and Judges in ensuring and implementing the basic principles of judiciary; the third chapter “Integration of Land Register Judges in the Land Register Reform” analyses the objectives and justification, as well as identifies the most important problems in the implementation of the reform in accordance with the basic principles of judiciary. The Author has concluded that as a result of the court power the basic principles have been implemented partially, but a significant role in the implementation of the court reform belongs to Court Presidents. The total volume of the Paper is 74 pages.
