Covid-19 izplatības ierobežošanas tiesiskā regulējuma ietekme uz civilprocesuālo tiesvedību

Abstract

Bakalaura darba ietvaros pētīts ārkārtējās situācijas tiesiskais regulējums tiesvedībā un tā ietekme uz civilprocesu. Ņemot vērā 2020. gada situāciju ar Covid-19 infekcijas izplatīšanos tika izsludināts ārkārtējais stāvoklis, ar kuru tika ierobežotas personu tiesības, kas attiecīgi ietekmē arī tiesu darbu. Tādēļ tiesām nācās pielāgoties un pāriet uz attālinātu lietu izskatīšanu arī gadījumos, kas ir ārpus Civilprocesa likuma tvēruma vai ārpus ierastās prakses. Ņemot vērā iespēju šādam situācijām atkārtoties un tehnoloģisko attīstību darba mērķis ir secināt vai Covid-19 izplatības laikā pieņemtais normatīvais regulējums varētu tikt piemērots arī ārpus pandēmijas apstākļiem. Lai to varētu nodrošināt likumā nepieciešams veikt precizējumus un papildinājumus, taču lielā mērā Civilprocesa likums paredz iespēju attālinātai lietu izskatīšanai.

The object of bachelors thesis is the legal acts declared during the emergency situation and it’ s effects on the Law of Civil proceedings. Based on the 2020 situation with Covid-19 spreading around the world, emergency stat was declared, which restricted persons rights, which consequently had effect on litigation. Therefor the courts had to adapt their procedures to ensure their work remotely, even in cases out of scope of the Law of Civil proceedings. As similar situations may occur in the future and the development of technology, the ai mis to understand the possibility of using the adapted process during Covid-19 spread. To ensure such process, there must be made changes in the law, however in many cases the existing legislations allows the process to be held remotely.
