Parādu piedziņas tiesiskā regulējuma problēmas

Abstract

Bakalaura darba mērķis ir konstatēt, kāda problemātika ir parādu piedziņas tiesiskajā regulējumā piemērojot to praksē, ar kādām problēmām var saskarties ārpustiesas parādu atgūšanas procesā, kā tiesas process ietekmē piedziņas procesu kreditoram un kādi ir tajā pastāvošie riski. Kā šīs parāda piedziņas procesa problēmas atrisināt un kā veicināt vienlīdzību starp parādu piedzinēju un parādnieku. Bakalaura darbs sastāv no ievada, trim nodalām un nobeiguma un ir uz 58.lpp Lai sasniegtu bakalaura darba mērķi, tiks pētīti spēkā̄ esošie normatīvie akti, citu valstu parādu piedziņas modelis un vēsture un juridiskā literatūra Bakalaura darba rezultātā̄ tiks secināts, kādas ir parādu piedziņas tiesiskā regulējuma problēmas ārpustiesas parādu atgūšanas procesā un tiesas ceļā.

The aim of the bachelor's thesis is to determine what are the problems in the legal regulation of debt collection when applying it in practice, what problems may be encountered in the out-of-court debt recovery process, how the court process affects the recovery process for the creditor and what are the risks. How can these problems in the debt recovery process be better resolved and is there equality between the debt collector and the debtor? The bachelor's thesis consists of an introduction, three chapters and conclusions and there are 58 pages. In order to achieve the goal of the bachelor's thesis, the valid regulatory enactments, the model and history of debt collection of other countries and legal literature will be studied. As a result of the bachelor's thesis, it will be concluded what are the problems of the legal regulation of debt collection in the process of out-of-court debt recovery and in court.
