Onkoloģijas ārstēšanas tiesiskā problemātika Latvijā un pārrobežu veselības aprūpē

Abstract

Bakalaura darba tēma ir onkoloģijas ārstēšanas tiesiskā problemātika Latvijā un pārrobežu veselības aprūpē. Tēma ir aktuāla, jo onkoloģijas dēļ Latvijā katru gadu nomirst ap 6500 cilvēku, kā arī 2020.gadā uzliesmoja vīruss COVID-19, kas ietekmēja pacientu iespējas saņemt veselības aprūpes pakalpojumus Latvijā un ārzemēs. Bakalaura darba mērķis ir, izpētot nacionālā tiesiskā regulējuma problēmas attiecībā uz onkoloģijas pacientu ārstēšanas procesu Latvijā un ārpus tās, sniegt tiesiskā regulējuma pilnveides iespējas. Bakalaura darba izstrādes gaitā autore pētīs cilvēktiesību tiesisko regulējumu veselības nozarē, pētīs starptautisko tiesisko regulējumu, Latvijas Republikas Satversmē garantētās tiesības uz veselību, nacionālo tiesisko regulējumu onkoloģija jomā, analizēs saņemtās atbildes par pārrobežu veselības aprūpes saņemšanu no Veselības Ministrijas, Veselības inspekcijas un Nacionālā veselības dienesta, kā arī pētīs vīrusa Covid-19 ietekmi uz veselības aprūpes saņemšanas kārtību. Bakalaura darba izstrādes gaitā autore sniedz atbildes uz jautājumiem par valstīm uzliktajiem pienākumiem, kas izriet no starptautiskā tiesiskā regulējuma, par valsts, ārstniecības iestāžu un ārstniecības personu pienākumiem onkoloģijas pacientu ārstēšanas procesā, kādas tiesības ir onkoloģijas pacientiem attiecībā uz pārrobežu veselības aprūpi, kā arī kā šobrīd tiek regulēta veselības aprūpes saņemšana Latvijā un pārrobežu veselības aprūpes saņemšanas kārtību. Bakalaura darbs sastāv no ievada, trim nodaļām, deviņām apakšnodaļām, nobeiguma un četriem pielikumiem, kopā bakalaura darba apjoms ir 70 lapas. Bakalaura darba pirmajā nodaļa tiks apskatīts starptautiskais cilvēktiesību tiesiskais regulējums un tā ietekme uz veselības nozari dalībvalstīs, ES tiesiskais regulējums pārrobežu veselības aprūpē un valstu pienākumi, kas izriet no starptautiskā un ES veselības nozares tiesiskā regulējuma. Otrajā nodaļā autore apskatīs nacionālo cilvēktiesību tiesisko regulējumu attiecībā uz veselības tiesībām un izpētīs nacionālo onkoloģijas ārstēšanas procesa tiesisko regulējumu. Trešajā nodaļā autore apskatīs onkoloģijas pacientu tiesības saņemt plānveida pārrobežu veselības aprūpi un kā Covid-19 vīrusa izplatība ir ietekmējusi onkoloģijas pacientu tiesības saņemt veselības aprūpi Latvijā un ārpus tās.

The subject of thesis work is the legal issue of oncology treatment in Latvia and cross-border healthcare. The topic is topical because in Latvia annually die approximately 6500 people because of oncology, as well as the virus Covid-19 flared in 2020, which affected patients’ opportunities to receive health services in Latvia and abroad. The aim of the Bachelor's work is to study the national legal framework for the treatment process of oncology patients in Latvia and abroad, to identify existing problems and to offer solutions to these problems. During the development of the Bachelor's work, the author studies the human rights legal framework in the health sector, study the international legal framework, the right to health guaranteed by the Constitution of the Republic of Latvia, the national legal framework in the field of oncology, analyze the received responses about cross-border healthcare from the Ministry of Health, Health Inspectorate and National health service, as well as study the impact of the virus Covid-19 on the regulation of health care. During the development of the Bachelor's work, the author will provide answers to the questions regarding the obligations imposed on States arising from the international legal framework, the responsibilities of the state, medical treatment institutions and medical practitioners in the treatment of oncology patients, , the rights of oncology patients in cross-border healthcare the receipt of health care in Latvia and the receipt of cross-border health care are regulated. The Bachelor's work consists of an introduction, three chapters, nine sub-chapters, a final and attachments, a total amount of the Bachelor's work is 70 pages. The first chapter of the Bachelor's work will examine the international human rights legal framework and its impact on the health sector in the Member States, THE EU legal framework for cross-border healthcare and national responsibilities arising from the legal framework of the international and EU health sector. In the second chapter, the author will look at the national human rights legal framework for health rights and research the legal framework for national oncology treatment. In the third chapter, the author will review at the right of oncology patients to receive planned cross-border healthcare and how the spread of the Covid-19 virus has affected the right of oncology patients to receive healthcare in Latvia and abroad. In the conclusion of the Bachelor's work will summarize the author's conclusions of the thesis and make proposals how to improve the legal framework of oncology treatment.
