Policijas darbinieka tiesības pielietot šaujamieroci cilvēktiesību ievērošanas kontekstā

Abstract

Pētnieciskais darbs 50 lpp. apjomā veikts ar mērķi noskaidrot tiesību uz dzīvību ievērošanas aspektus šaujamieroča pielietošanas gadījumos policijas darbā. Darba gaitā noskaidrots šaujamieroča tiesiskais regulējums, cilvēktiesību pamatprincipu ievērošanas pienākums policijas darbā, veikta judikatūras analīze. Tēmas aktualitāti pamato šaujamieroča kā letālas sekas radoša līdzekļa kvalifikācija. Pētījuma rezultātā konstatēta tiesību uz dzīvību ievērošanas problemātika, pielietojot šaujamieroci pret transportlīdzekļiem, un nepilnības šaujamieroča pielietošanas tiesiskajā regulējumā izmantoto jēdzienu formulējumā.

The research work in the amount of 50 pages has been carried out with the aim to clarify the aspects of observance of the right to life in cases of use of a firearm in police work. During the research the legal regulation of a firearm, the obligation to observe the basic principles of human rights in police work, and the analysis of case law were clarified. The actuality of the research is justified by the qualification of the firearm as deadly weapon. As a result of the research, the problems of observance of the right to life when using a firearm against vehicles and shortcomings in the wording of the concepts used in the legal regulation of the use of a firearm have been identified.
