Paternitātes priekšnosacījuma atbilstība bērnu tiesībām uzturlīdzekļu izmaksas kontekstā

Abstract

Bakalaura darba nosaukums ir „Paternitātes priekšnosacījuma atbilstība bērnu tiesībām uzturlīdzekļu izmaksas kontekstā”. Tā kā ne visos gadījumos bērnam ir iespējams noteikt paternitāti, nepieciešams analizēt, vai paternitātes priekšnosacījums atbilst bērna tiesībām saņemt izmaksas no Uzturlīdzekļu garantiju fonda, kad tēvs labprātīgi uzturlīdzekļus nemaksā un valsts iestājas tēva vietā. Darba gaitā tika secināts, ka attiecībā uz bērniem, kuriem nav noteikta paternitāte, tiek pieļauta diskriminācija. Likumdevējam būtu jāgroza Uzturlīdzekļu garantiju fonda likums un Civilprocesa likums, lai novērst diskrimināciju gadījumos, kad bērnam paternitāti noteikt nevar. Darba kopējais lappušu skaits ir 56.
