Abstract: Darbā „Psiholoģiskais komforts darba tiesiskajās attiecībās – tiesiskais regulējums un praktiskā īstenošana” autore ir pievērsusies no juridiskā aspekta maz pētītam darba tiesību aizsardzības jautājumam, proti, veselībai drošo un nekaitīgo darba apstākļu nodrošināšana. Jau gadiem vairs netiek runāts par darba drošību, darba labsajūtu, normālu darba vidi, kā tikai par darba aizsardzības prasību ievērošanu. Veselībai drošo un nekaitīgo darba apstākļu nodrošināšana sevī ietver tādus psihoemocionālos darba vides riskus kā piemēram, mobings un bosings, kuru skaidrojums Latvijas Republikas darba tiesību un darba aizsardzības regulējošos normatīvajos aktos nav atrodams, bet darba tiesiskajās attiecībās tiek lietoti, kā to parāda tiesu prakse. Darba mērķis ir analizējot jēdzienu psiholoģiskais komforts saistībā ar darba tiesiskajām attiecībām, izpētot veselībai drošo un nekaitīgo darba apstākļu būtību, kā arī noskaidrojot psiholoģiskā terora jēdzienus un veidus, to izpausmi darba tiesiskajās attiecībās, konstatēt problēmas un ieteikt tiesiskā regulējuma grozījumus. Pētījuma aktualitāti nosaka tas, ka 2020. gada februārī Tiesu administrācijas sistēmā meklējot pēc atslēgas vārda “mobings” varēja atrast 324 ierakstus 33 lapās, bet 2020. gada novembrī jau tika atrasti 520 ieraksti 52 lapās, atslēgas vārdam “mobings” un 298 ieraksti 30 lapās, atslēgas vārdam “bosings”. Nodarbinātie izvēlas risināt problēmas ārpus darba vietas, t.i. tiesu instancēs. Darba rezultātā secināts, ka problēma ir pietiekami izplatīta, normatīvajos aktos Latvijā nav tieša regulējuma, ko darīt mobinga un/vai bosinga gadījumos, jāizmanto vispārējais tiesiskais regulējums. Latvijas Republikas tiesību aktos nav nekādu jēdzienu par psiholoģisko teroru, kā arī Latvijas normatīvie akti skaidri nenosaka psiholoģiskā terora aizliegumu darba vietā. Darbs sastāv no 4 nodaļām, 3. nodaļa iedalīta sīkāk apakšnodaļās. Darba apjoms ir 51 lapas.
In the thesis “Psychological comfort in employment relations - legal regulation and practical implementation” the author has addressed the issue of protection of labor rights, which is little studied from the legal point of view, namely, ensuring safe and harmless working conditions. For years, there has been no talk of job safety, well-being at work, a normal work environment, but only about compliance with labor protection requirements. Ensuring safe and harmless working conditions includes such psycho-emotional risks in the work environment as, for example, mobbing and bossing, the explanation of which is not found in the labor law and labor protection regulations of the Republic of Latvia, but is used in labor legal relations. The aim of the thesis is to analyze the concepts of psychological comfort in relation to employment, studying the nature of safe and healthy working conditions, as well as to clarify the concepts and types of psychological terror, their manifestation in employment, identify problems and recommend changes in the legal framework. The topicality of the research is determined by the fact that in February 2020, 324 records on 33 pages could be found by searching for the keyword “mobbing” in the system of court administration, but in November 2020, already 520 records were found on 52 pages for the keyword “mobbing” and 298 records on 30 pages for the keyword "bossing". Employees choose to solve problems outside the workplace, i. e. in courts. As a result of the thesis, it has been concluded that the problem is widespread, there is no direct regulation in the regulatory enactments in Latvia, what to do in cases of mobbing and / or bossing, the general legal regulation should be used. The legislation of the Republic of Latvia does not contain any notion of psychological terror, as well as the regulatory enactments of Latvia do not explicitly prohibit psychological terror in the workplace. The thesis consists of 4 chapters, chapter 3 is furtner divided into subsections. Thesis consists of 51 pages.
