Eiropas Pieejamības akta izvirzīto prasību ieviešanas perspektīva Latvijā.

Abstract

Pētījuma tēma ir Eiropas Pieejamības akta izvirzīto prasību ieviešanas perspektīva Latvijā. Pētījuma mērķis – noskaidrot Eiropas Pieejamības akta noteikto prasību ieviešanas perspektīvu un paredzamos šķēršļus Latvijā. Lai nodrošinātu cilvēku ar invaliditāti pilnīgāku līdzdalību un iekļaušanos sabiedrībā, kā arī mazinātu Eiropas Savienības dalībvalstu tiesību aktu, kas reglamentē piekļuvi produktiem un pakalpojumiem, sadrumstalotību 2019.gada 17.aprīlī tika pieņemta Eiropas Parlamenta un Eiropas Padomes Direktīva (ES) 2019/882 par produktu un pakalpojumu piekļūstamības prasībām (turpmāk – Eiropas Pieejamības akts). Eiropas Pieejamības akts nosaka prasības konkrētiem produktiem un pakalpojumiem, kas attiecīgi Eiropas Savienības dalībvalstīm līdz 2022.gada 28.jūnijam jātransponē nacionālajos tiesību aktos. Jauna tiesību akta ieviešana un pārņemšana valstī var būt saistīta ar vairākiem izaicinājumiem. Tieši tāpēc ir būtiski saprast, kā ņemot vērā Latvijas pieredzi ar Apvienoto Nāciju Organizāciju Konvencijas par personu ar invaliditāti tiesībām ieviešanu, varētu notikt jau esošo prasību konkretizētāka tiesību akta ieviešana. Balstoties uz līdzšinējo pieredzi un ņemot vērā vienmēr mainīgo sabiedrību saprast, kādi šķēršļi būtu iespējami Eiropas Pieejamības akta ieviešanai. Pētījumam ir divas daļas – empīriskā daļa, kurā tiek analizēti dažādi starptautiskie dokumenti, pamatnostādnes un ziņojumi par personu ar invaliditāti tiesību priekšnosacījumiem un īstenošanu Latvijā. Pētījuma otrās daļas divās apakšnodaļās tiek aprakstīta pētniecībā izmantotā metodoloģija, kā arī veikto interviju analīze un apkopojums. Pētījumā izmantotas kvalitatīvās pētījuma metodes. Pētījumam ir 58 lappuses, 1 attēls un 2 pielikumi.

The topic of the research is the perspective of implementation of the requirements set by the European Accessibility Act in Latvia. The aim of the study is to find out the perspective of the implementation of the requirements set by the European Accessibility Act and the expected obstacles in Latvia. Directive (EU) 2019/882 of the European Parliament and of the Council on accessibility requirements for products and services (hereinafter referred to as the European Accessibility Act), was adopted 17 April 2019 in order to ensure fuller participation and inclusion of people with disabilities and to reduce the fragmentation of legislation in the Member States of the European Union governing access to products and services. The European Accessibility Act sets out the requirements for specific products and services that must be transposed into national law by the Member States of the European Union by 28 June 2022. The implementation and transposition of new legislation in a country can be subject to several challenges. That is why it is important to understand how, considering Latvia's experience with the implementation of the United Nations Convention on the Rights of Persons with Disabilities, a more specific implementation of the existing requirements could take place. Based on existing experience and considering the ever-changing society, understand what obstacles would be possible to the implementation of the European Accessibility Act. The study has two parts - the empirical part, in which various international documents, guidelines and reports on the preconditions and implementation of the rights of persons with disabilities in Latvia are analyzed. The two subchapters of the second part of the study describe the methodology used in the research, as well as the analysis and summary of the interviews. Qualitative research methods were used in the research. The study has 58 pages, 1 figure and 2 appendices.
