Eiropas Savienības “Likuma varas” koncepta pozicionējums Polijas partijas “Likums un Taisnīgums” diskursā no 2015. gada līdz 2023. gadam

Abstract

Bakalaura darbā “Eiropas Savienības “Likuma varas” koncepta pozicionējums Polijas partijas “Likums un Taisnīgums” diskursā no 2015. gada līdz 2023. gadam” tiek analizēts partijas izteikumi šajā laika posmā, lai sniegtu izpratni par ES “Likuma varas” koncepta pozicionējumu PiS partijā. Pētījuma aktualitāte tiek saistīta ar Polijas (PiS partijas) un ES izveidojušos konfliktu, laika posmā no 2015. gada līdz 2023. gadam, kas saistīts ar “Likuma varas” jautājumu. Kur partija veica izmaiņas Polijas tiesu sistēmā, ko ES institūcijas saskatīja, kā neatbilstību “Likuma varas” standartiem, kas minēti Līgumā par ES, tā iemesla pēc uzsākot 7. panta procedūru, kas ekselēja šo strīdu starp abām pusēm. Darba mērķis ir izpētīt kā Polijas partija PiS aktori savā diskursā pozicionē konceptu ES “Likuma vara” no 2015.gada līdz 2023.gadam. Lai mērķi sasniegtu tika izmantota dokumentu satura analīzi, kur tika analizēti PiS partijas izteikumi no Polijas valdības sēžu stenogrammām. Pēc PiS partijas deputātu paustajiem viedokļiem, tie tiek sadalīti atslēgas vārdos, kuri sniedz priekštatu jeb pozicionējumu par ES varas konceptu. Papildus, tika analizēti Polijas Ministru kabineta oficiālie dokumenti un Polijas prezidenta A. Dudas izteikumi, kas sniedza ieskatu par šo divu valsts struktūru pozicionējumiem par ES “Likuma varu”. No teorētiskās perspektīvas bakalaura darbā tika izmantota konstruktīvisma teorija, kas skaidroju un sniedza šo skatījumu par personas/ partijas ārpolitiskā viedokļa izveidošanos. Pētījumā tiekot pētītam partijas diskursam, konstruktīvisma teorija sniedza iemeslus kādi faktori/ konstrukti var ietekmēt partijas vai personas viedokļa izveidošanos. Darba hipotēzes, kas tika izvirzīta: Polijas partijas “Likums un Taisnīgums” savā diskursā pozicionē, ka ES “Likuma varas” koncepts apdraud valsts suverenitāti. Pētījuma noslēgumā tika secināts, ka PiS partijas deputāti Polijas valdībā, Ministru kabinets un Polijas prezidents diskursā poziocnē, kopumā, ka ES “Likuma vara” apdraud valsts likumdošanu, precīzāk, valsts konstitūciju. Partijai, uzskatot, ka konstitūcija nosaka valsts iekšpolitisko un starptautisko likumu atbilstību Polijai nevis ES “Likuma vara”. Turklāt, partija pozicionē, ka konstitūcija sniedz valstij “Likuma varu” un suverenitāti. Papildus, PiS partijas deputāti un prezidents diskursā pozicionē, ka ES vara apdraud valsts suverenitāti un nacionālās intereses. Jo ES institūcijas izmanto dažādus instrumentus, lai pakļautu Poliju savienības varai, ko PiS partija pozicionē savā diskursā kā draudu Polijai.

This Bachelor thesis examines “Positioning of the European Union's "Rule of Law" concept in the discourse of the Polish Law and Justice Party from 2015 to 2023” in order to better understand their position regarding the EU “Rule of law”. There was a conflict between the Polish PiS party and the EU during this period which prompted the selection of this thesis. It was the case in which the PiS party had made significant changes in the justice system, however, the EU institutions expressed concerns for the judicial system in Poland, stating that the new reforms do not meet the EU “Rule of law” standards. To address this issue, the European Commission initiated the EU Treaty Art. 7 procedure, and because of that conflict between the two sides escalated. The work aims to find out how the actors of the Polish PiS party position the EU “Rule of law” concept in their discourse from 2015 to 2023. To achieve this goal, document content analysis where used, to analyze PiS party statements from the Polish government transcript of the hearings. After that, the statements were divided in individual keywords and created in to tables and charts which gave the idea of the parties’ discourse about the EU “Rule of law” concept. Additionally, there where an analysis of the Cabinet of Ministers’ official documents and Polish President A. Duda statements that gave further insight into the PiS party position. From a theoretical perspective the study where, used constructivism theory which gave the analysis of how a person/ party formats opinion about foreign policy. Because the thesis examines PiS party discourse the theory gives insight into how the party members or person develop opinions about topics what factors contribute to creating them. The hypothesis of this study was Polish PiS party’s position in their discourse that the EU “Rule of law” concept threatens the sovereignty of the state. In the course of the study, it was possible to conclude that the PiS position regarding the EU “Rule of law” concept posed a threat to the Polish legislative system- state constitution. Furthermore, the constitution protects and grants Poland sovereignty and “the Rule of Law”. Moreover, the constitution determines domestic policy and EU law compliance with Polish law, not the other way around. Furthermore, there is a similarity in the discourse of the PiS party parliamentarians and the Polish president in that both parties see the EU “Rule of law” as a threat to Polish sovereignty and national interests. The position is that the EU institutions use different instruments in order to force Poland to give up their rights. Therefore, the PiS party contends that the EU “Rule of law” threaten Poland.
