Uzņēmuma līguma nošķiršanas no darba līguma nozīme darba tiesiskajās attiecībās

Abstract

Bakalaura darba “Uzņēmuma līguma nošķiršanas no darba līguma nozīme darba tiesiskajās attiecībās” mērķis ir izpētīt uzņēmuma un darba līguma tiesisko regulējumu un sniegt iespējamo problēmu risināšanu nošķirot uzņēmuma līguma no darba līguma darba tiesiskajās attiecībās. Praksē bieži rodas situācijas, kad noslēgtie līguma veidi neatbilst faktiskajiem apstākļiem, uz kuru pamata ir nodibinātas darba tiesiskās attiecības. Šā darba ietvaros, tiks analizēts Civillikums, Darba likums. Viens no kritērijiem ir šo līgumu veidu nošķiršana pēc kopīgām pazīmēm, kā arī noteikt tās pazīmes, kuras attiecināmas, ja noslēgts pretējs līguma veids. Šā darba ietvaros, darba autors analizēs līguma jēdzienu, tāpat arī analizēs uzņēmuma un darba līguma jēdzienu, lai būtu vieglāk izprast katra līguma nozīmi un definējumu. Tāpat darba autors izpētīs noslēgto līgumu būtību darba tiesiskajās attiecībās, uzņēmuma un darba līguma tiesisko regulējumu. Darba autors vēlas norādīt, ka tiks pētīta judikatūra, un pamatojoties uz nozīmīgākajām atziņām tiks izvirzīti arī dzen sekojoši priekšlikumi un secinājumi. Bakalaura darba izstrādāts trijās nodaļās un septiņās apakšnodaļās. Bakalaura darba apjoms ir 50 lappuses. Atslēgas vārdi: darba līgums, uzņēmuma līgums, tiesa, Darba likums, Civillikums.

The aim of the bachelor's thesis “The role of separation of a company contract from an employment contract in an employment relationship” is to study the legal framework of a company and an employment contract and to provide a solution to possible problems in separating a company contract from an employment contract. In practice, situations often arise where the types of contract entered into do not correspond to the actual circumstances on the basis of which the employment relationship was established. Within the framework of this work, the Civil Law, the Labor Law will be analyzed. One of the criteria is to distinguish these types of contracts according to common features, as well as to determine the features that are applicable if the opposite type of contract is concluded. In this work, the author will analyze the concept of contract, as well as the concept of company and employment contract to make it easier to understand the meaning and definition of each contract. The author of the work will also study the essence of the concluded agreements in the employment legal relationship, the legal regulation of the company and the employment contract. The author would like to point out that case law will be studied, and the following proposals and conclusions will be made based on the most important findings. The bachelor's thesis is developed in three chapters and seven subsections. The volume of the bachelor's thesis is 50 pages.
