Abstract: | Darba tēma ir „ Cesijas būtība un cesijas līguma tiesiskie aspekti”.
Latvijas Republikas Civillikumā cesija iekļauta, kopš tā pieņemšanas 1937. gadā, tomēr tajā iekļautais cesijas institūts, nekad nav ticis ne papildināts, ne arī grozīts, tāpēc to būtu nepieciešams uzlabot, novēršot cesijas tiesiskā regulējuma nepilnības.
Cesija skar visas tajā iesaistītās puses gan cedentu, gan cesionāru, gan arī parādnieku, bet Civillikums, galvenokārt, aizsargā parādnieka tiesības. Izstrādājot bakalaura darbu, autore konstatē nepilnības un izvirza priekšlikumus tiesību normu aktualizēšanai, kas vērstas uz cesionāra tiesisko aizsardzību un cedenta atbildību cedējot prasījuma tiesības.
Darba mērķis ir, izpētīt cesijas tiesisko regulējumu kopsakarā ar tiesu praksi, konstatēt tiesiskā regulējuma pastāvošās nepilnības un ieteikt tiesiskā regulējuma grozījumus.
Bakalaura darbs sastāv no trim nodaļām, kuras strukturētas apakšnodaļās. Pirmajā nodaļā, darba autore raksturo cesijas jēdzienu un būtību. Otrajā nodaļā tiek analizēts cesijas līguma jēdziens un būtība, forma un cesijas līguma ierobežojumi. Trešajā nodaļā autore pēta cesijas līdzēju – cesionāra, cedenta un parādnieka tiesiskās attiecības, uzsvaru liekot uz parādnieka un cesionāra tiesību aizsardzību un cedenta atbildības noteikšanu, prasījuma cesijas gadījumā.
Darba apjoms 49 lapas. The topic of the work is "The nature of cession and the legal aspects of the cession agreement". Cession has been included in the Civil Law of the Republic of Latvia since its adoption in 1937, however, the institution of cession included in it has never been supplemented or amended, so it should be improved by eliminating the shortcomings of the legal regulation of cession. The cession affects all parties involved in it, both the assignor and the assignee, as well as the debtor, but the Civil Law mainly protects the rights of the debtor. In her bachelor's thesis, the author identifies shortcomings and puts forward proposals for updating legal norms aimed at the legal protection of the assignee and the assignor's responsibility when assigning claim rights. The aim of the work is to study the legal regulation of cession in connection with court practice, to identify the existing shortcomings of the legal regulation and to recommend amendments to the legal regulation. The bachelor's thesis consists of three chapters, which are structured in subsections. In the first chapter, the author describes the concept and essence of cession. The second chapter analyzes the concept and essence, form and limitations of the assignment agreement. In the third chapter, the author examines the legal relations between the parties to the assignment - the assignor, the assignor and the debtor, emphasizing the protection of the rights of the debtor and the assignor and the determination of the assignor's responsibility in the case of assignment of the claim.
