Naida noziegumu krimināltiesiskie aspekti

Abstract

Bakalaura darba tēma ir naida noziegumu krimināltiesiskie aspekti. Šī darba mērķis ir analizējot naida noziegumu krimināltiesiskos apektus, identificēt problemātiku un izstrādāt ieteikumus tiesiskā regulējuma pilnveidošanai. Latvijā naida noziegumi ir novērojami diezgan bieži un ir radījuši bažas par to iespējamo pieaugumu. Arvien biežākas ir ziņas par vardarbīgiem uzbrukumiem saistībā ar aizspriedumiem, naidīgu izteikumu un diskriminācijas gadījumiem, un tas liecina par nepieciešamību izpētīt šo jomu daudz plašāk. Turklāt arī starptautiskajā līmenī ir pieaugoša interese par naida noziegumiem un to novēršanu, ņemot vērā to iespējamo ietekmi uz cilvēktiesībām un sabiedrības drošību. Arvien vairāk valstu un starptautisko organizāciju pievērš uzmanību šai problēmai un meklē efektīvus risinājumus, lai novērstu noziedzīgus nodarījumus, kas saistīti ar naidu. Kopš Krimināllikuma 149.1 panta iekļaušanas likumā, nav neviena notiesājošā sprieduma, kas liek domāt, ka tiesību normu ir problemātiskie piemērot praksē. Pantā ir noteikts, ka par diskrimināciju rasu, nacionālās, etniskās vai reliģiskās piederības dēļ vai par cita veida diskriminācijas aizlieguma pārkāpšanu, ja ar to radīts būtisks kaitējums, bet praksē būtisku kaitējumu ir vieglāk konstatēt, ja ir radies zaudējums naudas izteiksmē, taču ne tiesību aizskārumā. Bakalaura darba pētījuma rezultāti ir apkopoti secinājumos. Bakalaura darba apjoms sastāv no 65 lapām, darbā izmantoti 78 informācijas avoti. The topic of the bachelor's thesis is the criminal legal aspects of hate crimes. The purpose of this work is to analyze the criminal legal aspects of hate crimes, to identify problems and develop recommendations for improving the legal framework. In Latvia, hate crimes are observed quite often and have caused concern about their possible increase. Violent attacks related to prejudice, hate speech and discrimination are on the rise, suggesting the need to explore this area much further. In addition, at the international level there is also a growing interest in hate crimes and their prevention, taking into account their possible impact on human rights and public safety. More and more countries and international organizations are paying attention to this problem and looking for effective solutions to prevent hate crimes. Since the introduction of Article 149.1 of the Criminal Law into the law, there has not been a single conviction, which suggests that it is problematic to apply the legal norm in practice. The article stipulates that discrimination on the basis of racial, national, ethnic or religious affiliation or violation of the prohibition of other types of discrimination, if it causes significant damage, but in practice, it is easier to establish a significant damage if there is a loss in monetary terms, but not in violation of rights. The results of the bachelor thesis are summarized in the conclusions. The volume of the bachelor thesis consists of 65 pages, 78 sources of information are used in the thesis.
