Atbildību pastiprinošu apstākļu piemērošanas problemātika un to ietekme uz sodu

Abstract

Bakalaura darba temats ir “Atbildību pastiprinošu apstākļu piemērošanas problemātika un to ietekme uz sodu”. Krimināltiesībās atbildību pastiprinošie apstākļi praksē tiek piemēroti bieži un tie aptver plašu darbību un apstākļu loku, kas reālajā dzīvē notiek noziedzīga nodarījuma brīdī. Bakalaura darba mērķis ir aplūkot atbildību pastiprinoša apstākļa vēsturisko attīstību, tā būtību, analizēt atbildību pastiprinošu apstākļu piemērošanas problemātiku praksē un sniegt ierosinājumus to risināšanai. Bakalaura darba uzdevumi ir sekojoši – Izprast atbildību pastiprinošo apstākļu institūta būtību, pieļaujamību, mērķi un tā ietekmi uz sodu, izpētot tiesu praksi identificēt problēmjautājumus tā piemērošanā un sagrupējot atbildību pastiprinošos apstākļus rast ierosinājumus to pareizākai piemērošanai. Darba autors secina, ka tiesu praksē atrodami gadījumi kad tiesas nav motivējušas lēmumu piemērojot atbildību pastiprinošus apstākļus un pretēji. Ņemot vērā, ka nepareizi piemērojot šo tiesību institūtu soda apmērs būtiski tiek ietekmēts, darbā tiek apskatīts vai ir vajadzīgs veikt labojumus tiesiskajā regulējumā.

The subject of the Bachelor's work is “the problem of aggravating circumstances and their impact on punishment.” In criminal law aggravating circumstances are often applied in practice and cover a wide range of activities and circumstances that occur in real life at the time of the offence. The Bachelor's work aims to look at the historical development of an aggravating circumstance, its nature, to analyse the problem of the application of aggravating circumstances in practice and to make suggestions to address them. The tasks of the Bachelor are as follows: to understand the nature, permissibility, purpose and impact of the aggravating circumstances Institute on punishment by examining the jurisprudence of courts to identify problems in its application and by grouping aggravating circumstances to find suggestions for their proper application. The author concludes that there are cases in case law where the courts have not motivated the decision to apply aggravating circumstances and vice versa. Given that the incorrect application of that body of law significantly affects the amount of the penalty, the work examines or necessitates a legislative correction.
