Kriminālprocesā aizskartā mantas īpašnieka tiesiskais statuss

Abstract

Bakalaura darbā “Kriminālprocesā aizskartā mantas īpašnieka tiesiskais statuss” veiktais pētījums par kriminālprocesā aizskartā mantas īpašnieka tiesisko statusu sniedz ieskatu attiecībā uz kriminālprocesā aizskartā mantas īpašnieka procesuālo statusu, tiesību un pienākumu apjomu. Bakalaura darba aktualitāti pamato kriminālprocesā aizskartā mantas īpašnieka kā kriminālprocesā iesaistītās personas pamattiesību nodrošināšanas nozīme, īstenojot procesuālās darbības. Darbā tiek sniegts izklāsts par kriminālprocesā aizskartā mantas īpašnieka vispārīgu raksturojumu, jēdziena attīstību Latvijas tiesību sistēmā, kā arī tiesiskā statusa problemātiku gan pamata kriminālprocesos, gan procesos par noziedzīgi iegūtu mantu. Darbā tiek aktualizēta no tiesību normām un to piemērošanas izrietošā problemātika attiecībā uz kriminālprocesā aizskartā mantas īpašnieka tiesisko statusu. Darba noslēgumā tiek izdarīti secinājumu un izteikti priekšlikumi problemātikas novēršanai.

Bakalaura darba mērķis ir, izpētot kriminālprocesā aizskartā mantas īpašnieka tiesiskā statusa regulējumu, konstatēt problemātiku tiesiskajā regulējumā, izteikt priekšlikumus tiesību normu grozījumiem.

Bakalaura darba kopējais apjoms ir 53 lpp.

The study on the legal status of the owner of property infringed in criminal proceedings in the bachelor thesis "Legal Status of the Owner of Property Infringed in Criminal Proceedings" provides insight into the procedural status, rights and obligations of the owner of property infringed in criminal proceedings. The relevance of the bachelor thesis is based on the importance of ensuring the fundamental rights of the owner of the property infringed in criminal proceedings as a person involved in criminal proceedings in the implementation of procedural actions. Bachelor thesis provides an outline of the general characteristics of the owner of property infringed in criminal proceedings, the development of the concept in the Latvian legal system, as well as the problems of the legal status in both basic criminal proceedings and proceedings for criminally acquired property. The work highlights the problems arising from the legal norms and their application with regard to the legal status of the owner of the property infringed in criminal proceedings. The work concludes and proposes solutions to the problems.

The aim of the bachelor thesis is, by studying the regulation of the legal status of the owner of the property infringed in criminal proceedings, to identify problems in the legal regulation and to make proposals for amendments to the legal norms.
