Vieglo pasažieru transportlīdzekļu ar pilnu masu līdz 3.5t krāpšanās ar odometra rādījumiem tiesiskās sekas un problēmas Latvijā

Abstract

Bakalaura darba teorētisko daļu veidos nacionālais tiesiskais regulējums, administratīvo tiesību teorija analīze darba tēmas ietvaros, kas spēs palīdzēt izprast problēmas sakni un tās risināšanas nepieciešamību, starptautiskie normatīvie regulējumi, citu valstu pieredze odometru rādījumu krāpšanas gadījumos. Bakalaura darbs sastāvēs no trijām nodaļām, kur pirmajā nodaļā tiks apskatīts “krāpšanās ar odometra rādījumiem” tiesiskais jēdziens un būtība, to tehniskie risinājumi, ekspertu viedokļi un atzinumi. Nacionālā un starptautiskā pieredze zaudējumu aprēķināšanai saistībā ar tēmu. Otrajā nodaļā tiks apskatīti, analizēti un salīdzināti normatīvie regulējumi Latvijā un citās ES dalībvalstīs saistībā ar krāpšanos ar odometra rādījumiem. Patērētāju tiesību aizskāruma aspekta analīze tēmas ietvaros. Trešajā nodaļā tiks apkopota informācija par iespējamiem normatīvā regulējuma uzlabojumiem, izteikti piedāvājumi Ceļu satiksmes likuma grozījumiem. Piedāvājumi procesuālo darbību uzlabojumam, lai novērstu turpmāku transportlīdzekļu ar koriģētu nobraukumu nonākšanu tirgū.

The theoretical part of the bachelor thesis will consist of the national legal framework, the analysis of the theory of administrative law within the framework of the work topic, which will help to understand the root of the problem and the need to solve it, international regulatory frameworks, the experience of other countries in cases of odometer reading fraud. The bachelor thesis will consist of three chapters, where the first chapter will examine the legal concept and nature of "fraud with odometer readings", their technical solutions, experts' opinions and opinions. National and international experience in calculating damages related to the topic. The second chapter will examine, analyze and compare the regulatory framework in Latvia and other EU member states related to cheating with odometer readings. Analysis of the aspect of violation of consumer rights within the topic. In the third chapter, information on possible improvements to the regulatory framework will be gathered, proposals for amendments to the Road Traffic Law will be made. Proposals for the improvement of procedural actions to prevent further vehicles with corrected mileage from entering the market.
