Noziedzīgs nodarījums pret dabas vidi – nelikumīgas medības

Abstract

Bakalaura darba tēma ir “Noziedzīgs nodarījums pret dabas vidi - nelikumīgas medības.” Darba ievadā tiek pamatota izvēlētās tēmas aktualitāte, formulēts pētījuma mērķis, noteikti pētījuma uzdevumi un sniegti priekšlikumi nelikumīgu medību kā noziedzīga nodarījuma pret dabas vidi – nelikumīgas medības apkarošanā un novēršanā. Darba mērķis ir izpētīt Krimināllikumā paredzēto atbildību nelikumīgu medību jomā, izzināt kvalifikācijas problēmas, analizēt nelikumīgu medību tiesisko regulējumu, piemērošanas praksi un ieteikt risinājumus. Pētījumam tiek uzstādīti vairāki uzdevumi – apskatīt terminoloģiskos aspektus nelikumīgu medību jomā, izpētīt noziedzīga nodarījuma sastāvu un kvalificējošās pazīmes par pārkāpumiem un izanalizēt tiesu praksi par noziedzīgiem nodarījumiem, kas sasistīti ar nelikumīgām medībām. Pētījuma objekts ir krimināltiesiskās attiecības saistībā ar pārkāpumiem nelikumīgu medību jomā. Bakalaura darba pētījuma priekšmets – pārkāpumu nelikumīgu medību jomā tiesiskais regulējums. Darba izstrādes gaitā tiks analizēti tiesību akti, kas regulē kā arī paredz atbildību par nelikumīgām medībām, juridiskā literatūra, dažādi interneta resursi un tiesu prakses materiāli. Darba izstrādes gaitā tika pielietotas vairākas pētniecības metodes: analītiskā pētniecības metode, deskriptīvā pētniecības metode, deduktīvā pētniecības metode, induktīvā pētniecības metode, tiesību normu interpretācijas metodes (gramatiskā metode,sistemātiskā metode un teleoloģiskā metode). Bakalaura darbs sastāv no ievada, satura, trīs nodaļām,kas iever teorētisko un pētniecisko daļu, nobeigums, izmantotās literatūras un avotu saraksts.

The topic of the bachelor thesis is ‘’Crime against the natural environment - illegal hunting’’. The introduction of the thesis justifies the importance of the chosen topic, formulates the purpose of the study, defines the tasks of the study and provides proposals for combating and preventing illegal hunting as a criminal offence against the natural environment - illegal hunting. The main goal of this paper is to study the liability for illegal hunting under the Criminal Law, to explore the problems of qualification, to analyse the legal regulations on illegal hunting, the enforcement practice and to recommend solutions. The study has several tasks - to look at the terminological aspects of illegal hunting, to examine the constitution and qualifying elements of the offence and to analyse the case law on offences related to illegal hunting. The object of the study is criminal law in the area of illegal hunting offences. The subject of the bachelor thesis research is the legal regulation of illegal hunting offences. The work will include an analysis of the legislation, which regulate and provide responsibility for illegal hunting, legal literature, various internet resources and materials on case jurisprudence. Several research methods were applied in the development of the thesis: analytical research method, descriptive research method, deductive research method, inductive research method, methods of interpretation (grammatical method, systematic method and teleological method). The bachelor thesis consists of an introduction, a table of contents, three chapters, a theoretical and a research part, a conclusion, a list of used literature and sources.
