Operatīvā eksperimenta tiesiskie aspekti

Abstract

Bakalaura darbs “Operatīvā eksperimenta tiesiskie aspekti”, ir pētījums, kurā tiek pētīti jautājumi, saistībā ar operatīvo eksperimentu un provokācijas nepieļaujamību veicot šo operatīvās darbības pasākumu. Likumdevējs ir noteicis šī eksperimenta veikšanas nosacījumus, taču ir situācijas, kad nepareizi interpretējot tiesību normu, nekvalitatīvas izpildes dēļ vai pārkāpjot provokācijas aizliegumu eksperimenta laikā iegūtā informācija tiek atzīta par nelikumīgi iegūtu. Šos problēmjautājumus izceļ ne tikai Latvijas tiesu prakse, bet arī Eiropas Cilvēktiesību tiesas prakse. Pētījuma mērķis ir izanalizējot operatīvā eksperimenta veikšanas tiesiskos aspektus, identificēt problēmas saistībā ar provokācijas nepieļaujamību un izstrādāt priekšlikumus šo problēmu risināšanai. Darbā tiek analizēts operatīvā eksperimenta jēdziens un tā būtība, operatīvā eksperimenta tiesiskais regulējums, operatīvo darbību pasākuma rezultātā iegūtās informācijas izmantošana un izpētīta operatīvā eksperimenta atšķirība no speciālā izmeklēšanas eksperimenta. Darbs sastāv no ievada, trīs nodaļām un divām apakšnodaļām, nobeiguma, kurā ir iekļauti secinājumi par pētījuma gaitā iegūtajām atziņām un izteikti priekšlikumi operatīvā eksperimenta tiesiskā regulējuma pilnveidošanai, izmantotās literatūras avotu saraksta. Bakalaura darbā izziņas avoti lielākoties būs Latvijas Republikas likumi, tiesas spriedumi, Eiropas Savienības tiesas un Eiropas Cilvēktiesību tiesas judikatūra, zinātniskā literatūra, publikācijas un interneta resursi.

The bachelor thesis "Legal aspects of the operative experiment" is a study which examines the issues related to the operative experiment and the inadmissibility of provocation in this operative activity. The legislator has laid down the conditions for conducting this experiment, but there are situations where information obtained during an experiment is considered illegally obtained due to incorrect interpretation of a legal provision, poor execution, or violation of the prohibition of provocation. These issues are highlighted not only by Latvian case law, but also by the case law of the European Court of Human Rights. The aim of the study is to identify the problems related to the inadmissibility of provocation and to develop proposals for solving these problems by analysing the legal aspects of conducting an operational experiment. The work analyses the concept of operative experiment and its essence, the legal regulation of operative experiment, the use of information obtained as a result of an operative action and examines the difference between operative experiment and special investigative experiment. The thesis consists of an introduction, three chapters and two subchapters, a conclusion, which contains conclusions on the findings of the research and proposals for improvement of the legal regulation of the operative experiment, a list of literature sources used. The sources of reference in the bachelor thesis will mainly be the laws of the Republic of Latvia, court judgments, case law of the European Court of Justice and the European Court of Human Rights, scientific literature, publications, and internet resources.
