Laulības šķiršanas tiesiskais regulējums un tā problemātika

Abstract

Bakalaura darba tēma ir “Laulību šķiršanas tiesiskais regulējums un tā problemātika”. Bakalaura darba tēmas aktualitāti nosaka tas, ka Latvijā laulības šķiršanas statistika vēljoprojām ir augsta. Mūsdienās daudz pāru stājas laulībā, bet tikpat daudz laulāto pāru šķiras dažādu iemeslu pēc. Lielākajai daļai ģimeņu šis lēmums ir smags, bet tomēr tiek pieņemts, laužot, doto solījumu “mīlēt līdz nāve mūs šķirs”. Līdz ar šāda lēmuma pieņemšanu tiek ietekmētas ģimeniskās vērtības, kā arī tiek ļoti ietekmēta ģimenes psiholoģiskā un sociālā vide un ne tikai. Rodas dažādas tiesiskās sekas, piemēram, mantas dalīšana, saskarsmes tiesību noteikšana, uzturlīdzekļu maksāšanas pienākums. Bakalaura darba mērķis ir laulības šķiršanas tiesiskā regulējuma un šķiršanas procesa analīzes rezultātā identificēt problēmas un trūkumus laulības šķiršanas procesā, izdarīt secinājumus un izstrādāt priekšlikumus normatīvo aktu pilnveidošanai. Bakalaura mērķa sasniegšanai tika izpētīti un analizēti starptautiskie tiesību akti, normatīvie akti, dažādi interneta resursi, centrālās statistikas dati saistībā ar šķirtajām no noslēgtajām laulībām, kā arī dažāda Latvijas un ārzemju literatūra. Īpašu uzmanību autore pievērsīs statistikas datiem, Notariāta likumam un Civillikumam, Civilprocesa likumam, kā arī darbā izmantos tiesu praksi, zinātnieku un juristu rakstus, pētījumus. Bakalaura darba struktūra veidota, lai atspoguļotu laulības šķiršanās tiesisko regulējumu un tā problemātiku Latvijā. Bakalaura darbs sastāv no ievada, trīs nodaļām, deviņām apakšnodaļām, kā arī nobeiguma, kurā tiek izteikti priekšlikumi un secinājumi. Bakalaura darba kopējais apjoms ir 66 lapaspušu skaits, (18469 rakstu zīmes), 54 -kopējais literatūras skaits.

The topic of the bachelor thesis is "Legal regulation of divorce and its problems". The topicality of the subject of the bachelor's thesis is determined by the fact that divorce statistics in Latvia are still quite high. Of course, many couples are getting married these days, but just as many married couples are divorcing for various reasons. For most families, this decision is hard, but it is still taken, breaking the promise "to love till death do us part". With the adoption of such a decision, family values are affected, as well as the psychological and social environment of the family, and not only that. Various legal consequences arise, such as property division, determination of contact rights, obligation to pay maintenance. The aim of the bachelor's thesis is as a result of the analysis of the legal regulation of divorce and the divorce process, identify problems and shortcomings in the divorce process, draw conclusions and develop proposals for improvement of the regulatory enactments. In order to achieve the bachelor's goal, international legal acts, regulatory acts, various Internet resources, central statistical data related to divorced and concluded marriages, as well as various Latvian and foreign literature were researched and analyzed. The author will pay special attention to statistical data, the Notary Law and the Civil Law, as well as use court practice, articles of scientists and lawyers, researches in the work. The bachelor's thesis consists of an introduction, three chapters, nine subsections, as well as a conclusion in which proposals and conclusions are expressed. The total volume of the bachelor thesis is the 66 number of pages, (18469 characters), 54 total number of references.
