Pirmpirkuma tiesību tiesiskais regulējums

Abstract

Bakalaura darba “Pirmpirkuma tiesību tiesiskais regulējums” galvenais mērķis ir atklāt pirmpirkuma tiesību tiesiskā regulējuma problemātiku un ieteikt priekšlikumus pirmpirkumu tiesību tiesiskā regulējuma uzlabošanai. Bakalaura darbā būs veikta teorētiskā analīze un aplūkoti praktiski piemēri. Pirmpirkuma tiesības ir aktuālas darījumos ar nekustamo īpašumu. Šī tēma ir aktuāla, jo pirmpirkuma tiesību tiesiskajā regulējumā ir novērojamas vairākas problēmas, kuras ir nepieciešamas atrisināt, lai sabiedrībā nepieļautu šo tiesību pārkāpšanu un nodrošinātu to aizsardzību. Bakalaura darba pirmajā nodaļā sniegts šo tiesību vispārējs raksturojums, analizējot šo tiesību jēdzienu, vēsturisko attīstību un kādi normatīvie akti regulē šīs tiesības. Darba otrajā nodaļā tiks sniegts ieskats, kādi ir pirmpirkuma tiesību subjekti un objekti. Darba trešajā nodaļā autore analizēs likumisko un līgumisko pirmpirkuma tiesību praktisko realizāciju, lai noskaidrotu kādas ir nepilnības. Darba ceturtajā nodaļā tiks analizēts un salīdzināts citu valstu pirmpirkuma tiesību tiesiskais regulējums. Šajā bakalaura darbā ir atklāti pirmpirkuma tiesību tiesiskie un praktiskie aspekti un pirmpirkuma tiesību nozīme. Galvenie secinājumi un izvirzītie priekšlikumi ļaus pilnveidot Latvijas pirmpirkuma tiesību tiesisko regulējumu. Bakalaura darbs sastāv no 67 lappusēm un viena pielikuma. The main goal of the bachelor's thesis "Legal regulation of pre-emption rights" is to reveal the problems of the legal regulation of pre-emption rights and recommend proposals for improving the legal regulation of pre-emption rights. A theoretical analysis and practical examples will be discussed in the bachelor thesis. The right of first refusal is relevant in real estate transactions. This topic is topical, because several problems can be observed in the legal regulation of the right of first refusal, which need to be solved to prevent the violation of these rights in the society and to ensure their protection. The first chapter of the bachelor's thesis provides a general description of these rights, analyzing the concept of these rights, their historical development, and which legal acts regulate these rights. The second chapter of the work will provide an insight into the subjects and objects of the right of first refusal. In the third chapter of the paper, the author will analyze the practical implementation of the legal and contractual right of first refusal to find out what are the shortcomings. The fourth chapter of the paper will analyze and compare the legal regulation of the right of first refusal in other countries. This bachelor's thesis reveals the legal and practical aspects of the right of first refusal and the importance of the right of first refusal. The main conclusions and proposed proposals will make it possible to improve the legal regulation of the right of first refusal in Latvia. The bachelor thesis consists of 67 pages and one appendix.
