Abstract

Pētījuma aktualitāte: Tiek pētītas cilvēka (policijas darbinieka) pamattiesības uz privātās dzīves neaizskaramību aktuālajā tiesiskajā situācijā, digitalizācijas laikmetā, kad personas datu aizsardzības nodrošināšana ir apgrūtināta līdz ar tehnoloģiju parādīšanos, kuras zibenīgā ātrumā nodrošina datu plūsmu internetā. Pētījuma aktualitāti pamato arī Datu valsts inspekcijas statistikas dati par sūdzību skaitu datu apstrādes jomā un tiesas spriedumi, kuros ir noteikts, ka policijas darbiniekam ir tiesības uz personas datu aizsardzību. Pētījuma problēma: Likuma “Par policiju” 22. pants paredz to, ka policijas darbinieku aizsargā valsts, taču nav izstrādāts ne ārējais, ne iekšējais tiesiskais regulējums, kurš nodrošinātu policijas darbinieka datu aizsardzību no valsts puses. Tiesiskais regulējums par policijas darbinieku aizsardzību pastāv, taču tas ir nepilnīgs, nepieciešami grozījumi tiesiskajā regulējuma, lai nodrošinātu policijas darbinieka personas datu aizsardzību no valsts puses. Pētījuma mērķis: Izanalizējot tiesisko regulējumu policijas darbinieku personas datu aizsardzības jomā, identificēt problemātiku un ieteikt iespējamus risinājumus. Pētījuma rezultāti: Izanalizējot tiesisko regulējumu personu datu aizsardzības jomā, tika ieteikti grozījumi likumā “Par policiju”, norādot, ka policijas darbiniekam ir tiesības uz datu aizsardzību un iestādei, kurā policijas darbinieks pilda dienesta pienākumus, ir jāpalīdz tās realizēt, kā arī atsevišķā likumā piedāvāts ieviest administratīvo atbildību par nelikumīgu policijas darbinieka personas datu apstrādi. Piedāvāts saskaņot pašvaldības policijas un Valsts policijas normatīvos aktus formas tērpa nēsāšanas jomā, paredzot vārdu un uzvārdu aizstāt ar identifikācijas numuru.

Highlight of the study: The fundamental right of a person (a police officer) to respect for his or her privacy is being explored in the current legal situation, in an age of digitisation, in which ensuring the protection of personal data is difficult with the advent of technologies that provide data traffic over the Internet at a flash speed. Statistics from the data State Inspectorate on the number of complaints in the field of data processing and court judgments, which state that a police officer is entitled to the protection of personal data, also substantiate the validity of the study. Study problem: Section 22 of the Law on Police provides that the police officer is to be protected by the State, but no external or internal legal framework has been developed to ensure the protection of the data of the police officer by the State. There is a legal framework for the protection of police officers, but it is incomplete, and amendments to the legal framework are necessary to ensure the protection of personal data of a police officer by the State. Objective of the study: by analysing the legal framework for the protection of personal data of police officers, identify the problem and suggest possible solutions. Results of the study: When analysing the legal framework in the field of personal data protection, amendments to the Law on Police were recommended, indicating that a police officer has the right to data protection and that the institution in which a police officer performs official duties must assist in the implementation thereof, as well as in a separate law it is proposed to introduce administrative liability for unlawful processing of personal data of a police officer. It is proposed to harmonise the laws and regulations of the local government police and the State Police in the field of wearing a uniform, envisaging replacing the given name and surname with an identification number.
