Testatora tiesību tiesiskais regulējums un tā problemātika

Abstract

Daudzveidīgās testatora tiesības rada tādas mantojuma tiesību normu problēmas, kā testatora neprecīzas gribas izteikums, kas var radīt kļūdaini sastādītu testamentu. Neprecīzi izteikta griba, kas atspoguļojas kā uz mantinieka iecelšanu, tā arī mantas sadalījumu, kur testators nespēj nošķirt visas mantas novēlējumu no atsevišķa priekšmeta novēlējuma. Konkrēta priekšmeta novēlējums, domājot, ka testatora mantojumu sastāda viens priekšmets, aizmirstot par bankas kontiem, vērtslietām un citiem mantojuma priekšmetiem. Testatora tiesības piešķir testamentā novēlēt legātu, to neierobežojot, līdz ar to radot neskaidrību par to, kas notiek ar mantojuma atstājēja parādiem, ja testamentā tiek novēlēts legāts.
