Abstract
Komercdarbība ir neatņemama Latvijas tiesiskās infrastruktūras sastāvdaļa, kas kalpo par pamatu valsts ekonomikai, un viens no kontrolētākajiem komercdarbības veidiem ir azartspēļu joma.
Šis raksts ir veltīts azartspēļu regulējuma ierobežojumu izpētei azartspēļu kā komercdarbības veida regulējuma kontekstā. Darbā izskatītas gan Latvijas, gan Eiropas Savienības tiesību aktu normas, kas regulē azartspēļu (tostarp interaktīvo azartspēļu) darbību, kā arī ieviešamo ierobežojumu ietekme uz komersantu un patērētāju interesēm.
Darba mērķis ir, izanalizējot azartspēļu tiesisko regulējumu un tā piemērošanu, identificēt problēmjautājumus un ieteikt to risinājumu. Īpaša uzmanība tiek pievērsta problēmjautājumiem, kas saistīti ar azartspēļu reklāmas ierobežojumiem un pašvaldību rīcības brīvību azartspēļu organizēšanai nepieciešamo atļauju izsniegšanas jomā, kā arī to vietu regulēšanas jomā, kurās pašvaldībām ir tiesības aizliegt azartspēļu organizēšanu. Papildus minētajam interaktīvo azartspēļu kontekstā tiks skatīts jautājums par nacionālo licenču saņemšanas prasību atbilstību brīvas pakalpojumu sniegšanas principam Eiropas Savienībā.
Pētījuma rezultātā tiek piedāvāti secinājumi un priekšlikumi efektīvākam azartspēļu regulējumam komercdarbības kontekstā. Proti, četri priekšlikumi par grozījumu ieviešanu Latvijas normatīvo aktu noteikumos un viens priekšlikums par regulas par pašatteikušos personu reģistra normatīvo regulējumu Eiropas Savienības jurisdikcijās izstrādi un izveidi.
Darbs sastāv no 80 lapām, neieskaitot daba titullapu, anotācijas latviešu un angļu valodās un satura radītāju.

Commercial activity is an integral part of Latvia's legal infrastructure, which serves as the basis for the state economy, and one of the most controlled types of commercial activity is gambling. This thesis is devoted to the study of regulatory restrictions on gambling in the context of its regulation as a type of commercial activity. The thesis examines provisions of both Latvian legislation and the legislation of the European Union regulating activities in the field of gambling (including online gambling), as well as the impact of the introduced restrictions on the interests of merchants and consumers. The aim of the thesis is to analyse legal framework for gambling and its application, to identify problems related to it, and to propose a solution to the indentified problems. Particular attention is devoted to problematic issues related to restrictions on advertising of gambling, and to the freedom of action of local governments in the field of issuing permits necessary for the organization of gambling, as well as in the field of regulation of places in which local governments have the right to prohibit the organization of gambling. In addition, the issue of compliance of requirements for obtaining national licenses with the principle of free movement of services in the European Union will be considered in the context of online gambling. As a result of the research, conclusions and recommendations are proposed for more effective regulation of gambling as a type of a commercial activity, i.e., four recommendations on the introduction of amendments to the provisions of the Latvian regulatory framework, and one recommendation on the development of regulation on self-excluded persons register within the jurisdictions of the European Union. This thesis consists of 80 pages, excluding the title page, annotations in Latvian and English languages and the table of contents.
