Īpašuma tiesības uz cilvēka izcelsmes bioloģiskiem materiāliem

Abstract

Maģistra darba tēma ir “Īpašuma tiesības uz cilvēka izcelsmes bioloģiskiem materiāliem”.

Ievērojot biotehnoloģiju straujo attīstību cilvēka bioloģiskā materiāla izmantošanas jomā, kas rada jaunas tiesiskās attiecības, kuru objekti ir cilvēka izcelsmes bioloģiskie materiāli, Latvijas nacionālā tiesiskā regulējuma ietvaros nav paredzēts tiesiskais regulējums, kas nodrošinātu personas efektīvu tiesību aizsardzību visos potenciālos personas bioloģiskā materiāla izmantošanas gadījumos. Tāpēc maģistra darba mērķis ir izpētīt īpašuma tiesības uz cilvēka izcelsmes bioloģisko materiālu cilvēktiesību un civiltiesību perspektīvā, un identificējot pastāvošā nacionālā tiesiskā regulējuma problēmjautājumus sniegt ieteikumus tiesiskā regulējuma pilnveidošanai Latvijas tiesību sistēmas ietvaros.

Pētījuma rezultātā autore atbildēja uz izvirzītiem jautājumiem, izdarīja secinājumus un izteica priekšlikumus Latvijas tiesiskā regulējuma pilnveidošanai.

The topic of the Master’s thesis is “Property rights on human biological materials”.

Following the rapid development of biotechnologies in the field of use of human biological material, which creates new legal relations, the object of which are biological materials of human origin, within the Latvian national legal framework there is no legal regulation which would ensure effective protection of persons rights in all potential cases of use of such biological material. Thereof the aim of the Master’s thesis is to examine the property rights on human biological materials from the perspective of human rights and civil rights, and thus identifying the problems of the existing legal framework to provide recommendations for improving the legal framework within the Latvian legal system.

As a result of the research, the author answered the questions raised, drew conclusions and made proposals leading for improving the legal framework of Latvia.
