Ar brīvības atņemšanu nesaistītu drošības līdzekļu teorētiskās izpratnes un praktiskās piemērošanas problēmas

Abstract

Bakalaura darba temats ir “Ar brīvības atņemšanu nesaistītu drošības līdzekļu teorētiskās izpratnes un praktiskās piemērošanas problēmas”, kas ietver sevī pētījuma mērķi – detalizēti izpētīt ar brīvības atņemšanu nesaistītos drošības līdzekļus, pievēršot uzmanību drošības līdzekļa piemērošanai un izstrādāt pilnveidojumus kriminālprocesuālajā normatīvajā regulējumā, lai sekmētu drošības līdzekļu pielietojumu. Pētījuma mērķa sasniegšanai autore pielieto pētnieciskās un interpretācijas metodes. Pētījuma bāze sastāv no interneta resursiem, tiesību avotiem un literatūras. Darba mērķis ir analizējot ar brīvības atņemšanu nesaistītos drošības līdzekļus, identificēt problemātiku un ieteikt to risinājumu. Bakalaura darbam ir četras galvenās nodaļas – “Ar brīvības atņemšanu nesaistīto drošības līdzekļu vispārējs raksturojums un piemērošanas nosacījumi”, “Ar brīvības atņemšanu nesaistītu drošības līdzekļu veidi”, “Ar brīvības atņemšanu nesaistīto drošības līdzekļu kontrole” un “Ar brīvības atņemšanu nesaistīto drošības līdzekļa grozīšana vai atcelšana”. Bakalaura darbā darba autore piedāvā veikt Krimināllikumā un Kriminālprocesa likumā izmaiņas, apraksta savus secinājumus par konstatēto un piedāvā savus priekšlikumus. The topic of the bachelor's thesis is “Non-custodial security measures promlems of theoretical understanding and practical application problems”, which includes the research goal - to study in detail security measures not related to deprivation of liberty, paying attention to the application of the security measure and to develop improvements in the criminal procedural regulatory framework in order to promote security the use of funds. To achieve the goal of the research, the author uses research and interpretation methods. The research base consists of Internet resources, legal sources and literature. The aim of the work is to identify the problems and recommend their solution by analyzing the non-custodial security measures. The bachelor thesis has four main chapters – “General characteristics and conditions of application of non-custodial security measures”, “Types of non-custodial security measures”, “Control of non-custodial security measures” and “Amendment of a non-custodial security measure or cancellation”. In the bachelor's thesis, the author proposes to make changes to the Criminal Law and the Criminal Procedure Law, describes her conclusions about the findings and offers her proposals. In total, the bachelor's thesis has sixty-four pages. Key words: Criminal case, suspect, accused, bail, terms.
