dc.description.abstract | Pētījuma aktualitāte ir pamatojama ar to, ka Apvienoto Nāciju Organizācijas 2006. gada 13. decembra Konvencija par personu ar invaliditāti tiesībām tika ratificēta Latvijā 2010. gada 1. martā, un līdz ar to izdarīti grozījumi Civillikumā un Civilprocesa likumā, ieviešot jaunu ierobežotas rīcībspējas tiesisko regulējumu, kas aizstāja pilnīgās rīcībnespējas institūtu. Ierobežotās rīcībspējas institūts izstrādāts, pamatojoties uz Satversmes tiesas 2010. gada 27. decembrī pieņemto spriedumu lietā Nr. 2010-38-01 “Par Civillikuma 358. panta un 364. panta atbilstību Latvijas Republikas Satversmes 96. pantam” un ievērojot Apvienoto Nāciju Organizācijas 2006. gada 13. decembra Konvenciju par personu ar invaliditāti tiesībām. Tomēr izveidot detalizētu regulējumu rīcībspējas ierobežojumu noteikšanai personām ar garīga rakstura vai citiem veselības traucējumiem tomēr vēl arvien nav izdevies. Bakalaura darba izvirzītā problēma - nepieciešamās izmaiņas pastāvošajā tiesiskajā regulējumā, kas reglamentē ierobežotās rīcībspējas tiesisko institūtu personām ar garīga rakstura vai citiem veselības traucējumiem, lai efektivizētu un pilnveidotu šī tiesiskā institūta piemērošanu. Bakalaura darba mērķis: izpētīt fizisko personu ierobežotās rīcībspējas tiesisko regulējumu Latvijā attiecībā uz personām ar garīga rakstura vai citiem veselības traucējumiem, izdarīt secinājumus un sniegt priekšlikumus esošā tiesiskā regulējuma pilnveidei. Bakalaura darbā izvirzītā mērķa sasniegšanai darba autore pēta ierobežotās rīcībspējas tiesiskā regulējuma būtību un izanalizē rīcībspējas ierobežojumu noteikšanas pamatu; aplūko personu ar invaliditāti tiesības uz vienlīdzību tiesībspējas un rīcībspējas atzīšanā; izpēta rīcībspējas ierobežojumu tiesiskā regulējuma alternatīvos mehānismus, kas aizstāj aizgādnības institūtu. Bakalaura darba izstrādes gaitā izmantoti normatīvie akti, publicistika, tiesu prakses materiāli. dc.description.abstract | The relevance of the study is based on the fact that the United Nations Convention on the Rights of Persons with Disabilities of December 13, 2006 was ratified in Latvia on March 1, 2010, and as a result, amendments were introduced to the Civil Law and the Civil Procedure Law, introducing a new legal regulation of limited legal capacity, which replaced the institute of total incapacity. The institute of limited legal capacity was developed on the basis of the judgment of the Constitutional Court on December 27, 2010 in case no. 2010-38-01 "On compliance of Articles 358 and 364 of the Civil Law with Article 96 of the Constitution of the Republic of Latvia" and in compliance with the United Nations Convention on the Rights of Persons with Disabilities of December 13, 2006. However, it has not been possible to create a detailed regulation for the determination of functional capacity limitations for persons with mental or other health disorders. The problem raised by the diploma work is the necessary changes in the existing legal framework, which regulates the legal institute of limited legal capacity for persons with mental or other health disorders, in order to streamline and improve the application of this legal institute. The purpose of the diploma work: to investigate the mechanism of legal regulation of limited capacity for persons with mental or other health disorders in Latvia, draw conclusions and make proposals for the improvement of the existing legal regulation. In order to achieve the goal set in the diploma work, the author of the work researched the nature of the legal regulation of limited legal capacity and analyzed the basis for determining the limitations of legal capacity; examines the right of persons with disabilities to equality in the recognition of legal capacity and legal capacity; explores alternative mechanisms of legal regulation of capacity limitations that replace the institution of guardianship. In the course of developing the diploma work, regulatory acts, journalism, case law materials were used.
