Saskarsmes tiesību ar bērnu tiesiskais regulējums un nodrošināšana

Abstract

Bakalaura darba “Saskarsmes tiesību ar bērnu tiesiskais regulējums un nodrošināšana” mērķis ir analizēt saskarsmes tiesību ar bērnu tiesisko regulējumu un izpētīt kā saskarsmes tiesību īstenošana notiek praksē. Saskarsmes tiesības ir bērna un vecāku dzīves nozīmīga sastāvdaļa, kas ir atzīta ANO Bērnu tiesību konvencijā, Eiropas Cilvēka tiesību un pamatbrīvību aizsardzības konvencijā, Latvijas Republikas Satversmes 96.pantā, Civillikumā, Bērnu tiesību aizsardzības likumā. Tēmas aktualitāte saistāma ar Eiropas Cilvēktiesību tiesas 2023. gada 13. aprīlī pieņemto spriedumu "E.K. pret Latviju", ar kuru atzīts, ka izdarīts Cilvēktiesību un pamatbrīvību aizsardzības konvencijas 8. panta tiesību uz ģimenes dzīves aizsardzību pārkāpums. Eiropas Cilvēktiesību tiesa atzina, ka valsts iestādes nav laikā izpildījušas darbības un nodrošinājušas sprieduma izpildi. Darba pirmajā nodaļā autore analizējusi saskarsmes tiesību jēdzienu, analizējusi starptautiskos un Latvijas Republikas normatīvos aktus saskarsmes tiesību ar bērnu jomā. Darba otrā nodaļā analizēta saskarsmes tiesību ar bērnu nodrošināšana un ierobežošana. Bakalaura darba trešajā nodaļā darba autore apskata saskarsmes tiesībās ar bērnu praksē pastāvošo problemātiku. Arī statistikas dati norāda uz tēmas aktualitāti. 2022.gadā Latvijas pirmās instances tiesās tika izskatītas 1663 lietas, kas saistītas ar bērnu tiesībām. 2020. gadā šo kategoriju lietu skaits bija 898, par to vēsta Tiesu administrācijas Starptautiskās sadarbības un analītikas nodaļas dati. Vislielākais lietu skaita pieaugums ir par saskarsmes tiesību noteikšanu, ierobežošanu un atcelšanu – lietu skaits pieaudzis trīs reizes. No iegūtajiem statistikas datiem var secināt, ka vecāki savstarpēji nespēj vienoties par saskarsmes tiesībām ar bērnu. Bakalaura darba normatīvo aktu bāzi veido starptautiskie, Eiropas Savienības un Latvijas Republikas tiesību akti saskarsmes tiesību ar bērnu jomā, tajā skaitā, Bērnu tiesību konvencija, Eiropas Cilvēka tiesību un pamatbrīvību aizsardzības konvencija, nacionālie - Latvijas Republikas Satversme, Civillikums, Civilprocesa likums, Administratīvā procesa likums, Bērnu tiesību aizsardzības likums, Bāriņtiesu likums, Mediācijas likums, Eiropas Savienības Tiesas atziņas, Satversmes tiesas atziņas, Augstākās tiesas atziņas un spriedumi, kā arī citu instanču tiesu spriedumi. Bakalaura darbu veido 73.lpp. Pētījumā izmantotās literatūras saraksts sastāv no 78 avotiem latviešu, krievu, angļu valodā, normatīvajiem aktiem, tiesu prakses, judikatūras un periodikas.

The main goal of the bachelor's thesis "Legal regulation of ensuring contact rights with children" is to analyze the practical implementation of the legal regulation of contact rights with children, do conclusions, identify problems and propose improvements to the legal regulation. The right of contact is an important part of the life of the child and parents, which is recognized in the UN Convention on the Rights of the Child, the European Convention for the Protection of Human Rights, Article 96 of the Constitution of the Republic of Latvia, the Civil Law, the Law on the Protection of Children's Rights. The topicality is related to the judgment "E.K. v. Latvia" passed by the European Court of Human Rights on April 13, 2023, which recognized that there had been a violation of the right to protection of family life in Article 8 of the Convention for the Protection of Human Rights. The European Court of Human Rights recognized that the state authorities did not perform their actions on time and ensured the execution of the judgment. In the first chapter of the work, the author analyzed the nature of contact rights, looked at the concept of contact rights, analyzed the international and Latvian regulatory acts in the field of contact rights with children. The second chapter of the work author analyzes the provision and limitation of the right of contact with the child. In the third chapter of the bachelor's thesis, the author analyzes the existing problems in contact rights with children in practice. Statistical data also indicate the topicality. In 2022, 1,663 cases related to children's rights were considered in Latvian courts of first instance. In 2020, the number of cases in these categories was 898, according to the data of the Department of International Cooperation and Analysis of the Judicial Administration. The largest increase in the number of cases is about determining, restricting and canceling contact rights with children - the number of cases has increased three times. The legal basis of the bachelor's thesis is international, European Union and Republic of Latvia legislation in the field of contact rights with children, including the Convention on the Rights of the Child, the European Convention on the Protection of Human Rights, also national legislation - Constitution of the Republic of Latvia, Civil Law, Civil Procedure Law, Administrative Procedure Law, Law on the Protection of the Children's Rights, Law on Orphan's and Custody Courts, Mediation Law, judgments of the Court of the European Union, judgments of the Constitutional Court, judgments and judgments of the Supreme Court, as well as judgments of courts of other instances. The bachelor's thesis consists of 73 pages. The list of literature used in the research consists of 78 sources in Latvian, Russian, English, also including regulatory acts, court practice and periodicals.
