Ar brīvības atņemšanu nesaistītie pamata drošības līdzekļi

Abstract

Bakalaura darba temats ir “Ar brīvības atņemšanu nesaistītie pamata drošības līdzekļi”. Bakalaura darba aktualitāte pamatojama ar to, ka mūsdienās Latvijā ir ļoti svarīgi nodrošināt augstus standartus cilvēktiesību ievērošanā. Autore aplūko pamata drošības līdzekļus, kas nav saistīti ar brīvības atņemšanu, un noskaidro, pēc kādiem kritērijiem un prasībām jāievēro šādu drošības līdzekļu piemērošana un vai praksē visi pamata drošības līdzekļi tiek izmantoti. Saistībā ar pamata drošības līdzekļu izmantošanu praksē, autore saskaras ar domstarpībām, kuras analizēs bakalaura darba ietvaros. Bakalaura darbā pēta ar brīvības atņemšanu nesaistīto pamata drošības līdzekļu piemērošanas pamatojums, un ar to saistītās problēmas. Tiek norādītas tiesiskā regulējuma nepilnības un izteikti priekšlikumi tā pilnveidošanai. Baklaura darbs sastāv no divām nodaļām - pirmajā nodaļā autore raksturoja tiesiskajā regulējumā visus piemērojamos ar brīvības atņemšanu nesaistītos pamata drošības līdzekļus. Ar brīvības atņemšanu nesaistīto pamata drošības līdzekļu tiesiskā regulējuma analīzi, ar to saistīto problēmu izzināšanu un priekšlikumu izteikšanu tiesību normu tālākai pilnveidošanai. Otrajā nodaļā autore analizē ar brīvības atņemšanu nesaistīto pamata drošības līdzekļu piemērošanu Latvijā, pēdējo septiņu gadu laikā, kā arī pētīja tiesiskā regulējuma nepilnības un izteic priekšlikumus to pilnveidošanai. Sasniedzot bakalaura darba mērķi, izvirzītos darba uzdevumus, nobeigumā ir secīgi apkopoti tiesiskā regulējuma pilnveidošanai izteiktie priekšlikumi, pētījuma analīzes rezultāti, izdarīti secinājumi. Bakalaura darba izstrādes laikā tiek izmantoti Latvijas Republikas normatīvie akti, ka arī starptautiskie normatīvie akti, zinātniski pētnieciskie materiāli, tiesas spriedumi, apkopoti statistikas materiāli ar brīvības atņemšanu nesaistītajiem pamata drošības līdzekļiem. Darba apjoms ir uz 54 lappusēm.

The topic of the bachelor's thesis is "Basic Security Measures Unrelated to Deprivation of Liberty." The relevance of the thesis is based on the importance of ensuring high standards of human rights compliance in Latvia today. The thesis examines basic security measures that are not related to deprivation of liberty and determines the criteria and requirements for applying such security measures, as well as whether all basic security measures are used in practice. Regarding the practical use of basic security measures, the author encountered controversies, which will be analyzed within the scope of the bachelor's thesis. The thesis investigates the justification for the application of basic security measures unrelated to deprivation of liberty and the associated problems. It identifies legal regulation shortcomings and provides suggestions for their improvement. The bachelor's thesis consists of two chapters. In the first chapter, the author describes all applicable basic security measures in the legal regulation. It includes an analysis of the legal regulation of basic security measures unrelated to deprivation of liberty, exploration of related problems, and suggestions for further improvement of legal norms. In the second chapter, the author analyzes the application of basic security measures unrelated to deprivation of liberty in Latvia over the past seven years. It also examines the shortcomings of legal regulation and proposes suggestions for improvement. By achieving the goal and objectives set for the bachelor's thesis, the conclusions will summarize the suggestions for improving legal regulation, the results of the research analysis, and the overall findings. During the development of the bachelor's thesis, Latvian legislation, as well as international legal acts, scientific research materials, court judgments, and compiled statistical data on basic security measures unrelated to deprivation of liberty, are used. The scope of the thesis is approximately 54 pages.
